Supreme Court – Resolution of the Joint Chambers of 23 January 2020

The Joint Chambers: Civil, Criminal and Labour and Social Insurance on 23 January 2020 issued a landmark resolution on the fresh National Judicial Council (NRS).

Key thesis of resolutions:

1. The fresh KRS is not a legislative and executive authority independent

The SN considered that the way in which the judicial part of the KRS (chosen by the Sejm) was established does not hold its independence.

2. The composition of a court involving a justice appointed with the participation of a fresh NRS is defective

Where circumstances indicate a deficiency of independency and impartiality, this may lead to an inappropriate cast of the court.

3. A peculiarly critical assessment afraid the Disciplinary Board

The ultimate Court found that the Disciplinary Board is not a court within the meaning of national and EU law.

4. chance to challenge decisions

Judgments issued by a composition involving persons appointed with the participation of the fresh KRS may have been contested in certain situations.

PS. At the last gathering of the General Assembly of ultimate Court Judges, it was found that there was no quorum. any of the judges' absence explained "the vagueness of the position of those involved". The judges were to elect 5 candidates for the First president of the SN. In view of the situation, the vote has been postponed.
