Marcin Bogdan: president deprived of the Office - a state of emergency in Poland

Introduction

In fresh weeks, the issue of the EU SAFE debt has been a subject that has absorbed the attention of all those curious in politics. In the shadow of the subject, there was a plan B in question. In the Constitutional Tribunal, for respective or even respective months there were vacant judges. The vacancyes appeared as the word of office of individual judges passed. The first vacancy came in 2024 and the next in April and December 2025. No one's even tried to fill them. The case of filling these vacancyes appeared on the Sejm's bench respective hours after the president vetoed the SAFE Act. It was on Friday 13 March that the Sejm elected fresh judges to the Constitutional Court. However, during the selection, alleged "harmful errors" were made. The required time limits have not been retained from the candidate's application to the Sejm to vote on his candidacy. The deadline is 7 days. Over a year there were no vacancyes, and abruptly there was specified a rush that even 7 days couldn't wait? The rush was that during the presentation of the candidates the rapporteur omitted 1 candidate, he simply did not read his name. These "harmful mistakes" were made consciously and deliberately. due to the fact that it is hard to believe that the basic regulations of the Sejm are not known. It is besides hard to believe that waiting to vote for 5 more days, until the regular deadline, whatever would change. Why were these mistakes made? To carry out plan B.

Plan B

The president will not be able to take a vow from judges elected by the Sejm due to the fact that their choice was flawed. However, the government and the majority of the parliament will recognise that refusing to take a vow will be an omission by the President. Failure by the president means a situation in which the president does not act, which he should take. In a substantive sense, the president has no prerogative to recognise or not admit the election of a given justice to the Constitutional Court. Thus, the obstacle will be formal alternatively than substantive and in addition seemingly trivial, so it will be easy to convince people that the president has actually given up his duties. In addition, the president himself “informed” this without taking a vow.

Discharge of duties is not adequate reason to remove the president from office but may consequence in a temporary takeover of his duties by the Marshal of the Sejm. The president formally remains in office, but he is actually losing power. The president remains formally head of state, but does not execute his duties. This script is foreseen by the Constitution. If part of the public considers it a coup and goes out on the streets, the Sejm will ask the acting talker of the Sejm to introduce a state of emergency and Vladimir Czarzasty the state of emergency will announce. During the state of emergency, elections to the Sejm and to the Senate, local elections or even any national referendum will not be possible. But the Sejm will work and will vote on laws that the Blacks, as acting President, will sign. It is the Marshal acting as president who will accept the oath from the recently elected judges of the Constitutional Court and it is the Marshal acting as president that will revoke the current and appointment of the fresh president of the Constitutional Court. Without having to force, legally, legally. Then, in a short time, the euro will be introduced, defence issues will be assigned to a common European army and soon, at the request of the Sejm, acting as president Vladimir Czarzasty, will sign the act of Poland's accession to the United States of Europe, the leader of which will be the Chancellor of Germany.
