
The Tuesday gathering of the Constitutional Tribunal was based on a legal question of the territory Court in Zamość, who asked about the constitutional compatibility of the provisions of the Act on the publication of normative acts under which the Prime Minister issued the diary of Laws and the Monitor of Poland — where decisions of the Constitutional Tribunal concerning, among others, normative acts published in the diary of Laws are published.

According to a judgement published on the Court’s side, the Constitutional Tribunal held that Article 21 of the Act on the publication of normative acts and of certain another legal acts ‘understanding that the effects of the judgement of the Constitutional Court and the existence of an work for all public authorities to apply it are only updated erstwhile the method act consisting in the publication of that judgement in the authoritative diary of the Republic of Poland’ is incompatible with the constitution.

During the Tuesday meeting, the president of the Constitutional Tribunal, Bogdan Święczkowski, who was the rapporteur, pointed out that the publication of the judgement of the Court in the authoritative diary was ‘technical activity’ and that its absence ‘does not obviate the effects of the ruling and does not prevent its application by the authorities of the State — in peculiar courts’. However, the Prime Minister, who, under the provisions of the Act, issues the diary of Laws and the Monitor of Poland, does not have, as he said, “a certificate of competence to measure with legal effect whether the ruling can be promoted”, or a publication in the authoritative Journal.
At the same time, Świętczkowski assessed that the Prime Minister "has no right to interfere with the content of the ruling which he has been given, including any notes, introductions, notes or comments." Świętczkowski added that the function of the head of the government in this respect is reduced to "the execution of the order of the president of the Constitutional Court by the method transportation of the judgment".
