The 12th National household Law Seminar entitled “The educational impact of 3rd parties on minors” was held in the Centre for investigation on the Law Concerning the household of the Institute of Legal Sciences of the Polish Academy of Sciences in Poznań. The Institute of Justice was represented by dr hab. Maciej Domański, Deputy manager of the IWS and Dr. Bogusław Lackoronski, prof. IWS from the Section of Law and civilian Process.
Maciej Domański, PhD, discussed situations where interference is not a prohibited act, but actually affects the process of raising a child. The talker besides paid peculiar attention to the protection of household ties as a individual asset, referring to the current case law of the ultimate Court and the anticipation of utilizing preventive individual property protection measures.
Dr. Bogusław Lackoronski, Prof. IWS, spoke on the subject “Boundary of the freedom to enter into agreements for the care of minors”. He pointed out that these contracts are unnamed and akin to the contract of order, which allows a wide scope of freedom to form their content. At the same time, he stressed that they could not lead to the transfer or regulation of parental power. The talker pointed out the importance of custody contracts for minors as a origin of educational influence for 3rd parties. At the same time, he pointed out that specified agreements in practice could be assessed both as a manifestation of liable care for the kid and as a form of parental abdication.
