The compensation stems from the Guidelines of the Government Plenipotentiary for Persons with Disabilities. They were sent to all JCAs in December 2024, and mandate a simplification in the amount of the support benefit for disabled people aged 75+. This is due to the fact that the lawyer assumed that any individual of this age has elements of dependency independent of disability, and that money is due only for disability. So he ordered an arbitrary simplification in benefits for older disabled people aged 80, for example. This is evidently age discrimination. And of course there is no basis in the statutory provisions. And of course someday the Constitutional Court will deal with it.
