Veto, inactive veto. Nawrocki deepens legal chaos

– On 19 February, the President's Chancellery informed that president Karol Nawrocki had decided to veto changes concerning the National Judicial Council. What does this decision mean?

– The key nonsubjective of this amendment was to depoliticise the selection process of 15 judges of the National Judiciary Council. Let them choose them, as they erstwhile did, the judges among themselves, not the ruling majority of their nominees.

– What can be the most annoying thing about this veto for average Poles who will encounter justice?

– The Pseudoreforms of the judiciary proposed in the times of PiS and Zbigniew Ziobry proved to be anti-systemic, and the proceedings before individual courts increased by up to 50 – 60 percent. The chaos of questioning the position of alleged neo-judges is growing. The amendment to the Act was to regulate this status.

– How?

– Minister Waldemar Żurek divided the neojudges into 3 groups. any were to stay where they ruled – here we are talking about erstwhile asessors. any were to return to their positions, which they had previously held in lower courts, but with a delegation to a higher court for up to 2 years, so that they could finish their ruling on certain cases, and some, the alleged red group, promoted to courts from law practice, that is, there were lawyers, lawyers and prosecutors, were to part with the position of judge. These fresh regulations simultaneously restored the democratism of the election of the National Judicial Council.
