The Court of Justice will issue a WIBOR judgement tomorrow. Will millions of borrowers in Poland sue?

On February 12, 2026, at 9.30 a.m., the Court of Justice of the European Union will pronounce judgement in Case C-471/24, the first Polish mention for a mortgage in Polish zlotys at WIBOR. The case was referred to the TEU by the territory Court in Czestochowa and concerns an agreement concluded in 2019 with PKO BP S.A. The ruling may have a breakthrough impact on the full mortgage marketplace in Poland, as there are presently around 2 to 2.5 million active housing loans, the vast majority of which are gold loans with variable interest rates based on WIBOR. Contrary to how the subject is sometimes presented, the question is not simple: ‘Can WIBOR be challenged in court’, but only the consumer protection standard: transparency of the clause, scope of information provided to the client and fair distribution of risks.
