The European Commission is suing Poland to the EU Court of Justice for incorrect implementation of EU law on the right to a lawyer and initiating separate proceedings for deficiencies in legal assistance of its own motion. The case concerns first of all how suspects and defendants are treated in Poland at the earliest phase of criminal proceedings.
