Ladies and gentlemen,
Dear Directors and Teachers of household Friendly Schools,
in connection with the upcoming end of the school year and the ongoing classification councils we compose to you in an crucial case concerning the establishment of the average student rating.
In the face of legislative confusion, we remind that on 22 May 2025 the Constitutional Court issued a judgement concerning a regulation of the Minister of Education of 22 March 2024, stating its non-compliance with the Constitution of the Republic of Poland.
Therefore, in the light of that judgment, in the school year 2024/2025evaluation of religion must be taken into accountwhen determining the student's average rating.

In a published opinion, the Ordo Iuris Institute points out that schools have a work to take into account the assessment of religion erstwhile setting the end-year average. A student who has not been awarded a certificate due to failure to take account of the assessment of religion contrary to the judgement of the Constitutional Court may apply for a correction of the certificate. In addition, if not taking to the preferred advanced school caused material losses (e.g. as a consequence of lower level of teaching in the school to which it went) or intangible ones (e.g. stress), the student may effort to search compensation or redress under individual property protection legislation.
The Ordo Iuris Institute besides includes a model application that parents can submit to their child's school to request a spiritual rating to be included in the secondary. If, despite the submission of specified a request, these assessments are not included in the closing average and this will have concrete negative effects on the child, the Ordo Iuris Institute offers free legal assistance.
