The ultimate Court is facing a major reform. How He Reveals ‘Rzeczpospolita’, work is underway on a fresh law to reconstruct the conventional model of functioning of this institution. Changes will include, among another things, the elimination of controversial chambers appointed during the regulation of the Law and Justice, the modification of the way the president of the ultimate Court was elected and the limitation of the President's powers.
Back to 3 chambers – No more “new” structures
According to the newspaper, since the end of March the draft bill has been under improvement by the Codification Commission of the Judiciary and Public Prosecutor's Office at the Justice Ministry. The squad liable for the improvement is headed by an experienced justice SN Jarosław Matras.
– We want to return to the classical ultimate Court of 3 chambers. I believe that in this format it has functioned decently and efficiently in contrast to the SN that has been given us in fresh years – said justice Matras.
This means that two chambers established in the erstwhile word of office will disappear:
- Chamber of Professional Responsibility,
- Chamber of Extraordinary Control and Public Affairs.
Their powers will be taken over by the another chambers. In addition, an emergency complaint is to be abolished, that is, the alleged super-complainant, which allowed for the rebuttal of final decisions deemed to be ‘dangerously unfair’.
The president will lose influence on the election of the president of the SN and the rules of the court
Another major change will be new way to choose the first ultimate Court President. The president presently elects him from the 5 candidates presented by the General Assembly of SN judges. After the reform, heads of state will be on the desk only 2 candidatesto guarantee greater legitimacy for the future president.
The president will besides lose the right to establish SN regulations. The rules of action of the court are now to be shaped by the judges themselves through the General Assembly.
Less Judges – Forks alternatively of a rigid number
The fresh rules will besides specify number of judges in the ultimate Court. The current rules of procedure laid down by the president 125 judges. After the changes, this figure will most likely be determined as fork (from 80 to 120 people), which will let more flexibility.
When will change come into force?
For now, the draft is at the committee's stage, but if adopted, it could mean one of the largest judicial reforms in fresh years.
