The territory Attorney's Office in Warsaw called on erstwhile Prime Minister, presently MP of PiS Mateusz Morawiecki for a proceeding on 27 February about the envelope elections - Piotr Skiba, spokesperson for this prosecutor's office, announced on Monday.

In mid-January, the Sejm was asked to waive the immunity of Morawiecki in connection with the case of the alleged enveloped elections. The Prosecutor's Office accuses him that as Prime Minister he has exceeded his powers and has taken action to prepare and conduct the presidential elections on 10 May 2020 under purely correspondence without a legal basis.
A fewer days later Morawiecki reported that he himself waived immunity due to the fact that he knows that "truth, law and justice will prevail and the time of baseless, politically motivated charges will end".
"All my decisions during the word of office of Prime Minister of the Council of Ministers were dictated by the will to act in accordance with the Constitution of Poland and in the interests of the Republic of Poland - including, in particular, the work to defend the lives and wellness of citizens and to guarantee that they can exercise constitutional powers to democratically elect the president of the Republic of Poland" - stressed the Prime Minister in a letter to the talker of the Sejm.
"Current violation"
In the spring of 2020 - during the ongoing COVID-19 pandemic - the then head of government instructed Posta Polska to take the essential steps to prepare and conduct the presidential elections, which due to the spread of the coronavirus were to take place on 10 May 2020 in correspondence (the alleged envelope election).
The Correspondent Voting Act entered into force on 9 May 2020, while Morawiecki already issued 2 decisions on 16 April 2020: Polish Post - recommending action to organize presidential elections in the form of correspondence, and the State safety Printing Works - recommending the start of printing ballot cards and another papers essential in the election process.
The final election was not held on 10 May, only on 28 June, and the vote was held at the polling stations.
In September 2020, the WSA in Warsaw ruled that Prime Minister Morawiecki's decision requiring the Polish Post to prepare the presidential election in a correspondence vote She's grossly violated the law.. According to the WSA, Morawiecki's decision violated, among others, the Constitution, the Election Code, the Law on the Council of Ministers and the Code of Administrative Procedure. The WSA stated that the constitution or another laws do not grant the Prime Minister powers in the field aimed at organising general elections.
This judgement became final at the end of June 2024 after the ultimate Administrative Court dismissed cassation complaints from him.
