It is not known why benefits for the disabled depend on the age of acquiring the disability (this is the case, for example, in the social pension). The most drastic situation was in the care benefit (old). The regulations stated that the disability must mostly arise before the age of majority (exceptions for education). However, in 2014, the Constitutional Tribunal ruled that this was inconsistent with the Constitution of the Republic of Poland - there is no justification for the old care benefit not to be received by the carer of a disabled individual who is blind or uses a wheelchair from the age of thirty.
