Only in December we reported that there was an act of accusation against Antoni Macierewicz, who was to disclose classified information concerning, among others, the circumstances of the catastrophe in Smolensk. On Tuesday, January 27, the National Prosecutor's Office issued an authoritative message in which it informed that another motion for an MP of Law and Justice had been sent to the Marshal of the Sejm. This time Antoni Macierewicz would hear allegations about the September 2025 statement.
Antoni Macerewicz loses immunity? Waldemar Żurek applied to the Sejm
Minister of Justice and lawyer General Waldemar Żurek sent a request to the Marshal of the Polish Sejm, Vladimir Czarzast, to agree to bring Antoni Macierewicz to criminal work – the National Prosecutor's Office informed in a communication from 27 January.
The parliamentary immunity shall be protected against any charges imposed by Members, and its repeal shall be subject to the consent of the Sejm. Only then can a criminal be held liable. In the case of Antoni Macierewicz, the charges would be related to an investigation conducted by the Regional Prosecutor's Office in Warsaw.
"The basis for the referral of the application is the findings made on the basis of the evidence collected in the proceedings of the Regional Prosecutor's Office in Warsaw on the signature of Act 2010-5.Ds.42.2025 on the public insulting of the management of the Military Counterintelligence Service during and in connection with the performance of duties and the prosecution of conduct which may have humiliated these persons in the public opinion and put at hazard the failure of assurance essential for the performance of their duties, i.e. on the act of Article 226 § 11 k in conjunction with Article 231 a § 1 kk", informs the National Prosecutor's Office.
Materewicz on the management of the Military Counterintelligence Service
The case begins in 2025. On 11 September, during the 40th session of the Sejm of the 10th term, Antoni Macierewicz gave a speech in which he spoke about the heads of the Military Counterintelligence Service. As the National Prosecutor's Office informs, evidence has been collected in the case, including witness evidence and a transcript from the sitting.
The PiS MP then had, according to the prosecutor's office, the insult of the Chief of Service of the Military Counterintelligence Gen. Brig. Dr. Jarosław Stróżyk and his deputies, Col. Krzysztof Dusza and Col. Artur Pluto, and besides to discuss their cooperation with Russian peculiar Services. Antoni Macierewicz was to call the officers "Russian agents".
"The public dissemination of false claims about the alleged agential cooperation of the Military Counterintelligence Service management with Russian peculiar services violates the good name and authority of public officers acting on behalf and on behalf of the State. This action besides undermines the seriousness and credibility of the body liable for protecting against threats to the defence of the Republic of Poland, as well as the safety and combat capabilities of the Armed Forces of the Republic of Poland" is the justification.
From the communication we learn that, although the act is mostly prosecuted by private prosecution, due to the "relief of the case" the prosecutor decided to include him in the prosecution of his own motion, based on a social interest.
