The European Commission has lodged a complaint against Poland with the TEU for many years exceeding nitrogen dioxide standards in Kraków and advanced Silesian agglomerations. The NO2 level has been above the limits for more than a decade and, according to the EC, Poland has not implemented effective measures to reduce the time of infringements, despite the obligations under the EU Directive.

Air protection plans presume compliance in 2026. The Commission points out that there is inactive a crucial gap between current concentrations and limit values. 1 of the key solutions was to be low emissions zones, but their introduction is delayed: in Krakow they are to start in 2026, and in advanced Silesia they are inactive not planned. The EC besides points to shortcomings in another contamination control tools.

Excessive NO2 levels have serious wellness consequences, including respiratory and cardiovascular diseases. In Poland, due to the long-term vulnerability to NO2 about 1.6 1000 people may die annually.
