PiS president demanded Kuczyński apologize for his tweets. He blamed Lech Kaczyński for the disaster in his entries. The court considered that individual property had been infringed, but this was not illegal.

There will be no apology
The court added that the entries violated the emotional sphere of Jarosław Kaczyński, but were part of the public debate. Kuczyński was to exercise constitutional rights concerning freedom of expression. The court did not deal with the causes of the Smolensk disaster.
Agata Bzdyń, quoted by the HR, explained that, according to the court, "a lot can be said and cannot be unduly limited in political debate," she said in an interview with “Rzeczpospolita”.
