In mid-August, the first trial will be held in connection with a suit against Jarosław Kaczyński by Zbigniew Komasa. The activist claims that during the celebrations of the alleged Smolensk monthly magazine at the monument of the catastrophe in Piłsudski Square in Warsaw Kaczyński "twice hit him in the face". Following these events, Komasa filed a private indictment on the basis of Article 217 of the Criminal Code, which mentions the violation of physical immunity.

On 14 August, the first trial will be held in connection with the suit of Zbigniew Komasa against Jarosław Kaczyński. Komasa accuses the president of PiS of hitting him in the face twice during the celebration of the alleged Smolensk monthly in front of the monument in Piłsudski Square in Warsaw. The event was to take place on October 10, 2024. The indictment concerns Article 217 of the Criminal Code – violations of physical immunity.

The trial had already begun on 4 March that year, but the date of the first proceeding was postponed due to the failure of the parties to scope an agreement. The proceeding was scheduled to take place on 23 April, but was then postponed to 17 June due to the legitimate absence of the referee. Another change of deadline – this time on 14 August – was requested by the defender Jarosław Kaczyński.

Komasa offered Kaczyński a deal. The PiS would apologize for “the lie about the assassination”

If Kaczyński had agreed to the settlement offered by Komasa and his lawyer, the PiS would have apologized for the "liing of the assassination" in Smolensk, and alternatively the activist promised to halt demonstrating in front of the monument to the Victims of the Smolensk Tragedy and retreat the prosecution.

The proposal was valid until the vote on the waiver of parliamentary immunity was held on 6 December last year. The Sejm then voted to take the privilege distant from the president of the Law and Justice. 241 Members were "for" and 206 were "against". no abstained.
