Kaczyński replied with Article 212 of the Criminal Code. It's a court decision!

On Tuesday, the decision of the Warsaw-Śródmieście territory Court in the case of Jarosław Kaczyński, who was accused of defamation by the Euro MP Krzysztof Brejza. This was to be revealed in the words of the president of PiS, who accused Brejza of committing “serious” and “disgusting” crimes. The court decided to dismiss the case due to the low harm of the act.

The case afraid the words spoken by Jarosław Kaczyński during the session of the Parliamentary Committee of enquiry for Pegasus. The president of PiS then stated that Krzysztof Brejza had committed "serious crimes".

"A crucial policy of opposition formation is allowed to be very serious and, at the same time, disgusting crimes" was the message that was the subject of the legal dispute.

The Warsaw-Śródmieście territory Court ruled on Tuesday that the act that Kaczyński committed fulfilled the marks of defamation in accordance with Article 212 of the Criminal Code, but due to the low harmfulness of the act the case was dismissed.

"Mr Kaczyński was aware that this conduct and the conduct that Mr Brejzie was attributed were to be done many years ago and he was aware that Mr Brejza had never been convicted for this and that he had never been charged. He should not say publically that Mr Brejza has committed a crime," said justice Tomasz Trębicki, quoted by polsatnews.pl.

"In the judgement of the court, Mr Kaczyński's behaviour is not socially harmful to the degree that he exceeds the limits of criminal responsibility," said justice Trębicki.

Krzysztof Brejza and his lawyer – and privately besides his wife – met Dorota Brejza are not satisfied with the decision of the court.

“This is not a good judgment. We will definitely apply present or next day for a justification for this judgement and I will circular it with an appeal," said the mec. Brejza.

Krzysztof Brejza announced that the appeal against the judgement would be filed on the same day.
