Judge Skudlarek – the computer that took the human body

Bartłomiej Szkudlarek, justice of the territory Court in Piotrków Trybunalski, appeared in the nationwide media on 3 September 2016. This was during the Extraordinary legislature of Polish Judges in Warsaw, where the justice of the NSA Irena Kamińska described the judicial environment as "a completely extraordinary cast of people".

The Skudlarek spoke in front of an auditorium consisting of nearly a 1000 of his relatives and urged them to actively improve their image utilizing the same marketing tools as the police. He besides expressed doubts about the effectiveness of the resolutions taken at the congress, saying that if they were sent in writing to the president of PiS Kaczyński, he would make them a plane and let the cat go (read: ignore).

At the time, he was 35 years old, and it seemed that his career in the judiciary was over, as Kaczyński hated criticism from the “educated” and even more so the judges to whom he always felt disgust. Disputable comments after the judge's speech appeared in the media and online. In the lead were those who considered Skudlark's monologue to be ridiculous or even infantile.

Anonymous

Almost a period after the justice spoke to the editors, he reached an anonymous address. It is from this minute that the interest of the “Gazeta Trybunalska” character Szkudlarka should be counted. In the envelope there was a letter to the president of the territory Court, how easy it was to guess, in Piotrków, which function, at the time, was held by SSO Mariola Mastalerz. At the bottom of the page there was a handwritten annotation: “For the news of Mr. Editor”.

Promotion of the Strong in Spirit

Meanwhile, the incorruptible justice was promoted. He became president of the 1st civilian Division of the territory Court in Piotrków Trybunalski, and shortly afterwards its president, which was the culmination of his career in the judiciary.

In parallel with his wife Elizabeth, a doctor, a lactating counselor, he actively participated (and inactive participates) in the life of the Catholic Church. The relation of the justice with the holy, universal and apostolic institution goes far beyond the 5 church commandments.

There are respective pastoral communities at the Jesuit Parish of the Holy Name Jesus in Łódź. The largest and most dynamic is the collective “Strong in the Spirit”. They started in 1987 under the name of the Center for the Restoration in the Holy Spirit and this was the answer – as we read on the website “MwD” – to the needs of the renewal communities in the Holy Spirit throughout the country. In 2021, the parish established the Strong in Spirit Foundation, and the Archbishop of Łódź metropolitan gave it the position of church organization. As of 1 September 2021, the full community's activities were transferred to the Spirit Strong Foundation. Szkudlarek is simply a associate of the review committee and informs the current entry in the KRS.

The Foundation is simply a serious employer, employs nearly 90 people. Within it there are respective spiritual circles, school, kindergarten, children's home, intellectual counseling, dayroom, publishing house, bookstore and vocal-instrumental ensemble of the same name, in which there are respective twelve people.

Judge Skudlark's wife is simply a vocalist and he's a guitarist, and he writes words and makes music for songs performed by spiritual bands, record and music videos, touring, conducting evangelization talks on the Internet, writing columnaries. He besides owns Product list of a preaching character which can be purchased online. It's low. The description of the file entitled “God's triangle” reads:

In the second part, Bartek Szkudlarek leads us to stand before God without a mask, without pretending, but encourages us to honestly bring a dispute with God, a dispute that leads us to actual intimacy.

His designation as an author-music-mentor is far greater than a justice of the universal court. adequate to add that channel “MwD” on YouTube has over a 4th of a million subscribers, and Facebook page Over seventy thousand. Leader

From 2016 to 2019 Szkudlarek served as the leader of the community, or individual in the form of a manager or president of the group council.

At the end of the term, members of the Catholic Assembly prepared a 15-minute Thanksgiving film. The video was released on YouTube, where it enjoyed considerable viewing. At the minute erstwhile “Gazeta Trybunalska” began asking uncomfortable production questions, she was given “private” status. Still, he didn't vanish completely off the grid.

From the movie we learn that Bartek Szkudlarek is the chief, the evangelization machine, the computer that adopted the human body, the human institution that can be relied on due to the fact that he is unbreakable, the Yogi bear with a very large intellect.

Right

In Article 178(3) of the Constitution of the Republic of Poland, the legislator states:

The justice shall not belong to a political party, a trade union or engage in public activities incompatible with the principles of the independency of courts and the independency of judges.

By contrast, the Act of 27 July 2001. The law on the strategy of common courts in chapter 2 describes the rights and obligations of judges. Article 86 reads:

§ 1. The justice may not take additional employment, but in the teaching, technological or technological capacity, in a full dimension not exceeding the full working time of the staff employed in those posts, if the performance of that employment does not hinder the performance of the duties of the Judge.
§ 2. Nor is simply a justice allowed to take another business or a way of earning, which would hinder the performance of the duties of a judge, which could undermine his assurance in his impartiality or give him the dignity of his office.
§ 4. The intention to take additional employment referred to in § 1 and to take another business or way of earning, the justice of the appeal court and the justice of the territory court shall inform the president of the competent court and the Presidents of those courts - the Minister of Justice. The justice of the territory Court shall address the announcement referred to in the first conviction to the president of the competent territory Court.

In addition to the laws, an crucial paper covering professional, public and private spheres is The Judges' Professional Ethics Principles Collection passed and regularly amended by the National Judicial Council – a constitutional body that upholds the independency of courts and the independency of judges, established in 1989.

There were besides the following orders:

§3a The justice should avoid any kind of individual and economical relation with natural, legal or another entities, as well as avoiding actions in the private, professional or public sphere that could make a conflict of interest and thereby adversely affect the perception of the justice as an impartial individual and undermine assurance in the office of judge.

§23 The justice should exercise restraint over social media.

“Gazeta Trybunalska” writes to the Ministry of Justice

At the end of September 2016, the editorial board contacted Sebastian Kaleta, a press spokesperson for the Ministry of Justice. The telephone conversation resulted in a letter with questions addressed to the ministry. Although any of them sound funny, we realized that they could be of usage soon. However, the main nonsubjective was to learn the opinion of the ministry on the activities performed by Bartek Szkudlarek.

Can a practicing SR judge, in accordance with the applicable law, at the same time as the active pursuit of the profession of judge, conduct another commercial activities, e.g. by being a vendor in his own grocery and monopolic store, a compartment operator in a solarium, an alarm assembler, an importer of utilized tyres and others, or a creative and estrading activity consisting, for example, in writing and publishing (under his own name) crime stories, performing as an erotic dancer, a associate of a squad playing spiritual music, black-metal, disco-polo, which besides appears on tv talent-show programs, etc.?

The same question applies to classes for which the SSR does not receive remuneration, pursuing its creative, hobby, sports or social passions. In another words, can the justice sing in the church choir and touring, be the authoritative advisor to the parish priest, the city president or the president of the horticultural and bee cooperative? Can he be a municipal councilman, president of a club of old clocks, whiskey and cigar experts, a hot air balloon pilot, a kung fu master or a Tarocist?

Can a practicing SSR be an active associate of a sect, a Church, a spiritual union, lead an evangelization, execute publically as a proclaimer of spiritual ideas and values, conduct education on the streets or in homes?

Are there any contraindications for the justice to meet at banquets, picnics and dinners with prosecutors, lawyers, counsellors he then sees at court meetings?

According to our knowledge, there are no limitations if the additional work for which remuneration is paid or not, is connected with the profession of judge, for example lectures at a university, writing comments and articles for legal periodicals, etc.

In consequence to the “GT”, Wioletta Olszewska, head of the Department of Social Communication and Promotion at the Minister's Office, signed. The most crucial paragraph from a comprehensive letter is this:

Existing regulations do not indicate that a justice should not have interests, passions and prosecute them in private life, in his spare time. The justice may decide on how he spends time outside of work, but his hobbies related to, for example, sports, collectivism or artistic creation should be carried out in the light of the fact that peculiar duties and individual limitations are active in the performance of the office of judge. In carrying out his passions, the justice should follow good customs and take care of the authority of his office.

“Tribunalska newspaper” asks

On 28 May 2019, “Gazeta Trybunalska” addressed the then president of the territory Court in Piotrków SSR Piotr Koćmiel and the president of the SSO territory Court Stanisław Tomasik with the following question:

Did SSR Bartłomiej Szkudlarek, acting as president of the 1st civilian Division in SR in Piotrków Trybunalski, address the president of the territory Court in Piotrków asking for an expression consistent with the conduct of publicist and amusement and spiritual activities, consisting of: performances in the music band “Strucni in spirit” (guitarist), recording and selling records, writing texts and music to spiritual songs, writing columnaries to web portals and conducting lectures, talks and retreats, as “Community Leader”?

In response, both presidents denied that specified a conclusion would scope them.

The judge’s evangelical and phase career grew rapidly. Recordings and videos came online. For this reason, on 26 November 2021 – little than a period before the appointment of Szkudlark as president of the territory Court – we one more time asked both presidents:

1. Did the current president of the First civilian Division of the SSR Bartłomiej Szkudlarek, on the Internet, who was represented as Bartek Szkudlarek, apply to the president of the SO in Piotrków for approval to evangelization activities within the “Power in the Spirit” community in Łódź, where he served as the “leader of the community”?

2. Did SR SSR Bartłomiej Szkudlarek, a.k.a. Bartek Szkudlarek, apply to the SO president in Piotrków for approval to execute music, i.e. recordings and performances of the band “Strucni in spirit” for whom he wrote words and music specified compositions as “God is good”, “The foundation is Love”, “Come, embrace my soul”, “The Holy Spirit smiled” and many others?

3. Did SR SSR Bartłomiej Szkudlarek, a.k.a. Bartek Szkudlarek, apply to the SO president in Piotrków for approval to print in portals and spiritual publications?

4. Did SR SSR Bartłomiej Szkudlarek, a.k.a. Bartek Szkudlarek, apply to the president of the SO in Piotrków for approval to evangelizate in the group “The Mercy of God and the evidence of Blessed Graces”?

President Koćmiel one more time assured that he had no authoritative cognition of Szkudlark's actions, but he besides tempted to say: “As you know, the widely understood spiritual activity in Poland is not regulated (for the time being)” and in another letter he added: “(...) I declare that the activity of Mr. Law on the strategy of Common Courts (i.e. Dz. U. of 2020, item 2071) and a set of professional ethics principles of judges and judicial asessors and does not require the consent of the superior.”

President Tomasik acted differently. He refused to answer by making the applicable decision. The Schudlar's superior did not head the fact that 2 years earlier he had no opposition to supply the answer. This time he referred to the article. 47 The Constitution says everyone has the right to the protection of private life, household life, honour and good name and to decide on their individual life, what a lawyer from the Citizens' Network Watchdog Poland, to whom “GT” requested an explanation of the justification for the decision, found pointless.

The next question was addressed by “GT” on 13 January 2022, i.e. at the time erstwhile the president of the Szkudlarek department became president of Szkudlarek. The questions were as follows:

Two weeks later, the president referred Decision No 1/22 and refused to answer 5 of the 9 questions, considering that the questions relate to “public individual privacy”. In this way, the God - fearing typical of the judiciary made it clear that the work to notify the superior of taking another seizure does not apply to him. Just in case, he stated that in March 2020, and thus after being posted on the Internet, by the community of “Structured in the Spirit”, a thank-you movie in which he was called “the device for evangelization” made a appropriate message to the competent authorities. However, he did not indicate which authorities or what the applicable message was. The following answer:

Chapel, crosses, catechism?

In the spring of the same year, “GT” received incredible information about Szkudlarek seeking to make a chapel in court, hang crosses in courtrooms and equip them with catechism. Since the Law and Justice governments were abounding in many absurd or even insane decisions, we asked for confirmation of these ideas to the origin (read: > “There will be no chapel in the territory Court in Piotrków, nor even crosses on walls”).

Silence before the storm

Parliamentary elections in 2023 led to a change in government. The Ministry of Justice headed Adam Bodnarwho took as a point of honor “cleaning up” after his predecessor Herb. This dared, among others, the persons employed in the Piotrkowski court to object to president Szkudlark.

Two articles

On 16 March 2024, ed. Mariusz Jałoszewski published an article entitled “Oko.press” on the portal “Oko.press” “Judges appeal to Bodnar for faster resignations of CEOs than Ziebra. erstwhile associate of neo-KRS’. You can read it:

Judges in courts across Poland, they request faster removal of CEOs-nominates of erstwhile Minister of Justice Zbigniew Ziobra. They don't trust them and they don't want to work with them. The Minister of Justice Adam Bodnar has so far dismissed 5 Presidents of the Court and initiated procedures for appeals in the Olsztyń and Kraków districts.

The latest is about 3 courts. It's an appeal:

– president of the territory Court in Piotrków Trybunalski Bartłomiej Szkudlarek. The minister's appeal for his appeal was addressed by the employees of this court. The appeal is anonymous due to the fact that the employees are afraid of reprisals for sending it. The schmuck is heavy active in spiritual activity. The community he was associated with received millions from the Justice Fund.

Tomasz Matusiak, writer of the Łódź edition of “Gazeta Wyborcza” ed. In the material entitled “The appeal of the president of the Court shall divide the judges. Protest following the decision of Minister Adam Bodnar’ wrote:

Then there were more writings against president Skudlarek. On 12 March, the Ministry received a letter signed “Workers of the territory Court in Piotrków Trybunalski” (without surnames) and on 28 March already signed by 19 judges of that court (there are 22 judges in the aforementioned communication, but the minister’s letter is already mentioned). These judges demanded that their president be dismissed before the end of their word of office – as shortly as possible. They pointed out that justice Szkudlarek was appointed to the post by Minister Zbigniew Ziobra without consulting the general judges in the territory Court of Piotrków Trybunalski.

All judges in the territory Court in Piotrków Trybunalski are 34. The authors of these writings accuse justice Szkudlarek of moving a staff policy according to illegible and non-standard criteria. According to the complaints, this policy is intended to include non-extinuation of functions for many years and to favour people with lower experience, according to illegible rules. There are besides allegations of defamation or disregard of information about alleged mobbing in 1 of the departments. The relation between the employees of this department and the president of Szkudlarek was very tense.

The Minister of Justice has decided to initiate the appeal procedure, considering that the continued function of justice Szkudlark cannot be reconciled with the good of the judiciary.

In the final part of the material ed. Matusiak states:

According to our unofficial findings, we are dealing with a dispute, or even a individual conflict in the territory Court in Piotrków Trybunalski, which has lasted for respective years – although there is no evidence of it in the authoritative reports on the operation of the court.

He besides asks the question: “Can justice Szkudlarek return to office?” though it should be: should justice Szkudlarek proceed to rule?

Deputy Disciplinary Officer

There is no evidence that deputy disciplinary officer at the Piotrków territory Court neo-judge Anna Gąsior-Majchrowska (read: > “The court has valued man's life at PLN 7,000”) saw any irregularities in the judge's attitude, which seems so unusual that in 2020, as the only deputy spokesperson in Poland, she began to prosecute judges from the Piotrkowski territory who signed a letter to the OSCE on the organisation of the alleged enveloped elections (read: > “Who appointed A. Gąsior-Majchrowska as Deputy Disciplinary Ombudsman in Piotrków? The spokesperson for Schab is outraged, “Iustitia” responds”).

To make certain Gąsior-Majchrowska was not curious in Skudlarka, “GT” tried to contact the spokesman. It turned out that he was on vacation and might return to work in early August this year.

The Golden thought of the Scarecrow

The speech of the justice at the Warsaw legislature presented at the outset of this article included a digression:

If we do not take care of our image actively, the media will take care of our image themselves. And what benefits the media is evil, not good.
