The State Election Commission has again rejected the financial statements of the parties of Grzegorz Braun, Confederation of the Polish Crown. The consequences of rejection may be very serious for the parties, as they consequence in the failure of subsidies.
– The State Electoral Commission concluded that the data shown in the study and in part of the papers submitted do not correspond to the actual facts and that the study was not accompanied by all the papers required in the abovementioned Regulation – this is simply a fragment of the justification for the resolution adopted on Monday by PKW. It rejected KKP's financial statements for 2021. A akin situation occurred in 2020. At the same time, PKW rejected the financial statements of the NCC co-founding organization of the Confederation. 1 of the key findings was that in 2020 KKP had as many as 43 bank accounts, but it showed the controllers the past of operations only 4 of them. – In the case of the remaining thirty-nine, [send – ed.] only confirmation of their balances at the end of 2020, which did not make it clear that no financial operations were carried out during the reporting period (the organization did not supply specified confirmation from the bank holding its accounts) – was justified by that resolution.
PKW besides alleged that KKP was to forget to show the adoption of non-monetary values, e.g. the lending of premises. In addition, PKW was to have a problem with details on bank deposits.
In 2022, in connection with the case of the Modern Party, which PKW besides rejected the financial study in 2018, the Ombudsman spoke.
– The Ombudsman shares the doubts as to the unconstitutionality of the provisions concerning the control of the study in conjunction with the automatic sanctioning of its rejection in the event of any failure, peculiarly severe for parties who are entitled to a subsidy from the budget. The Ombudsman emphasises that the government was introduced to counter corruption and financial irregularities in the functioning of political parties. The legislator's intention to reduce the hazard of political corruption in the functioning of the political organization strategy was clear, including illegal gaining benefits from illegal sources. However, the full failure of the right to a subsidy should be the most severe and final solution, which can only be applied if the infringement in question was of a very large scale or peculiarly reprehensible nature and posed a serious threat to the organization system. – read on RPO page.
Given that Mr Braun is not a favourite and friend of the system, the question arises whether rejecting the KKP's accounts is not an effort to cut the organization off from the subsidy, which would entail a powerful blow to the successful functioning of the party.
