The public opinion was shaken by the fact that a nine-month-old unborn kid was deprived of life in the region infirmary in Oleśnica. 2 weeks before delivery, the boy, named in the media “Feel”, was killed by an injection into the heart of a potassium chloride solution.
Last summer, a female was admitted to the Clinic of Pregnancy Pathology and Gynecology at the Medical University of Łódź in the 35th week of pregnancy, with the diagnosis of congenital bone fractures in the child, known from the media as “Mrs Anita”. As Prof. Piotr Sieroszewski, the head of this facility and the president of the Polish Society of Gynecologists and Obstetricians explained in his statement, congenital bone fracture is simply a defect where there is targeted treatment without the request for experimental therapy, and the Department of Pregnancy and Gynecology UM in Łódź is the mention centre for specified cases.
During the consilium with geneticist and neonatologist, doctors proposed p. Anita a pregnancy solution through an imperial cut with further, highly specialized treatment of the kid at the Pediatric Clinic. Doctors have informed the patient of fresh treatments, so that children with congenital bone fractures can stay active and independent. Importantly, children with specified a defect are full intellectually capable.
Ms Anita agreed to the proposed treatment plan, but after 2 days she reported signs of a suicidical crisis and submitted to psychiatric consultation. Psychiatrists decided to observe her for 3 days, due to her intellectual state and suicidal thoughts. According to the "Electionary" which made the case public, the investigation showed nothing disturbing.
On completion of the observation, at the time of the obstetrics Consilium, Mr Anita presented to the physicians a letter drawn up by the advocate of the Foundation for Women and the “Feder household Planning”, requesting that the “guaranteed wellness care in the form of abortion” be provided, given the hazard to physical and intellectual health. The recommended solution was to ‘induction of foetal ascites’, i.e. to kill a kid already able to live outside the mother’s body by injecting a potassium chloride injection into his heart. According to the “Election”, the basis for specified a request was the opinion of a psychiatrist who stated “resignatory thoughts”. ‘Electoral’ revealed that the Consilium of the Diagnostic and Observatory Division besides issued an opinion that in the case of Ms Anita ‘there are conditions for the termination of pregnancy’. The opinion was to be signed by, among others, psychiatrist, dr hab. n. med. Małgorzata Urban-Kowalczyk.
As Prof. Sieroszewski explains, in specified a situation, university doctors proposed an immediate termination of pregnancy by imperial cutting, in general anesthesia, with the kid receiving highly specialized neonatal treatment and then paediatric therapy without the request to affect the patient in the care and treatment process after birth. Mr Anita was besides presented with the chance to waive parental rights and take over care of the newborn by qualified state institutions.
Ms Anita yet rejected the doctor's proposal, so she was discharged from the clinical infirmary in Łódź on her own request after stabilising her intellectual state.
Ms. Anita, with a psychiatric certificate, went to the well-known abortion practice, the Regional infirmary squad in Oleśnica. A fatal procedure was performed by the drug. Gizela Jagielska, Deputy manager of Medicine, the only 1 – as “Electoral” writes – who agreed to this. The doctor confirmed that she performed the procedure during the 36th week of pregnancy, utilizing the method indicated by Ms Anita and her lawyer. Jagielska considers the child's deprivation of life just before birth, by injecting potassium chloride solution into the heart, as the most safe and “used in the modern world”. In a public message she rejected the view that the procedure performed was an abortion. It took six hours to deliver the kid who was killed.
A spokesperson for the territory Attorney's Office in Wrocław, proc. Karolina Stocka-Mycek confirmed in an interview with the “Sunday Guest” that there is an investigation into abortion with the consent of a female in Oleśnica, but in violation of the provisions of the Act, that is, erstwhile the conceived kid achieved the ability to live independently outside the woman's body. She pointed out that there had not been a study of a crime committed and that the prosecution had taken up the case itself after media reports. The case concerns an act under Article 152(3) of the Criminal Code in conjunction with Article 152(1). This provision provides for a punishment for an abortion between six months and 8 years in prison, while a female is not punishable.
The Act of 7 January 1993 on household Planning, Protection of the Human Fetal and Conditions of Admissibility of Abortion does not specify until which week of pregnancy it may be discontinued in the event of a threat to the life or wellness of a pregnant woman. Due to unclear legal wording and the deficiency of a strict definition of "health hazard", abortions, including late ones, are increasingly taking place due to intellectual wellness risks. Abuse of the condition of a mother's wellness hazard by extending it to threats, even temporary and short-term, broadly understood intellectual health, leads not only to the actual implementation of the eugenic condition, but actually introduces abortion “on request”, and this throughout the pregnancy, until the expected transportation date.
Gizela Jagielska, who had already conducted this barbaric procedure, said in an interview with the “Electionary” that “we are beginning the door of a psychiatrist’s certificate besides much.” At the same time, while moving for the position of gynecology and obstetrics consultant in Lower Silesia, Jagielska believes that abortion on request should be allowed until 22 weeks of pregnancy, and abortion in the event of foetal defects or a threat to the wellness and life of the parent to its end.
Dr hab. n. med. Tomasz Dangel, specialist in anesthesia, intensive therapy and palliative medicine, The president of the Warsaw Children's Hospice Board stressed in his statements that it is impossible to arbitrarily claim that the kid will endure after birth, and in most cases medicine can master the suffering. As an expert in pain management in children and paediatric palliative care, Dr. T. Dangel has not met a patient who could not be helped in this regard. In rare, most hard cases, the alleged terminal sedation is used, consistent with medical and Catholic ethics. "Therefore, the claim that an unborn kid should be killed, due to the fact that it will endure after birth, I consider it false and demagogue," says Dr. T. Dangel.
The drama in Oleśnica shows the public how easy it is to usage the deficiency of precision of the legislature in formulating government and to kill unborn children in an almost unlimited way on the basis of ministerial guidelines, which have only the position of recommendations, alternatively than affirmative law.
