Law Hall: ‘The courts request to be cleared, but the scalpel, not the axe’

During the debate on Television, the Republic of candidates for president discussed the state of the law in Poland. Szymon Hołownia, leader of Poland 2050, emphasized that Poles request a smooth justice system, and the current problems arise from actions of the erstwhile government.

“Poles wait twice as long for justice”

The Hołownia pointed out the lengthened time limits for examining cases:
The regulation of law is pure explanation if you cannot assert your rights. [...] Thanks to the “reforms” of Ziobra and the patron of Mr Nawrocki, president Duda, Poles must wait not 9 months to settle their case in civilian court in First Instance, only 16 – he said.

The politician announced that as president he would reconstruct the regulation of law, including:

  • Separation of the functions of Minister of Justice and lawyer General,
  • ‘Clarification of courts’ – verification of neoKRS nominations,
  • Reform of the Constitutional Court, which presently deals mainly with complaints of the Law and Justice.

Zandberg: "Instability destroys trust in the state"

Adrian Zandberg (Together) stressed that the biggest problem is citizens' uncertainty about the feasibility of judgments:
After 10 years of this conflict between the PiS and the Platform, people in Poland are not certain whether or not the conviction will apply in their case. This is 1 of the worst things that can happen in social, economical life – a deficiency of sense of stability.

According to Zandberg, the solution needs constitutional changes, as the government's actions to date have not corrected the situation.

What about the Polish justice system?

The debate showed that both Holovnia and Zandberg see the request for deep reforms. Key challenges are:

  1. Restoring the independency of courts,
  2. Shortening the processing time,
  3. Rebuilding citizens' assurance in the legal system.

Will the fresh authorities take effective action? Time will tell.
