Glapinski is not the last boss

Yesterday we wrote about a preliminary paper in which there were 8 main charges against Adam Glapiński. They were to bring the head of the National Bank of Poland to the Court of State. Prime Minister Donald Tusk announced the readiness to do so. You can read everything HERE.

Politico reports that the head of the NBP can defend himself with a much more powerful opponent. It is possible that the European Central Bank (ECB) most likely intends to stand up for Adam Glapiński, claiming that it thus protects the independency of the NBP in accordance with the provisions of the Treaty on European Union.

In view of the plans of the majority of the Sejm to put the president of the NBP before the Court of State, there is so a hazard that they besides search to dismiss him from his office.

What does the Constitution say about this?

According to the Constitution, the dismissal of the president of the NBP is possible only in strictly defined cases. We are talking about factors specified as a long-term illness preventing the performance of duties, a final conviction by the court, a false message of mirrors or a judgement of the Court of State prohibiting the taking of positions in state institutions.

Despite erstwhile announcements by any coalition politicians, including Donald Tusk, about the possible departure of Adam Glapiński from the NBP, this has not happened so far. However, the request to place Glapinski before the Court of State was signed by Members. In order to decision on, he must gain the support of 115 parliamentarians.

According to ‘Politico’, the governing plans may be thwarted by the ECB. His boss Christine Lagarde warned in a letter from December last year against extremist actions against the NBP. She noted that the Statute of the ECB provides protection for the president of the national central banks in the event that the Sejm initiates criminal proceedings, thus preventing its appeal from being ex officio.

2 out of 8 pleas declared ‘questionable’

As mentioned in the preceding article, the paper contains 8 charges. Politco, however, believes that at least 2 of them are “questionable”.

The magazine explains that through the acquisition of government bonds, which included charges against Glapiński, the NBP provided indirect financing of the budget deficit of at least PLN 144 billion. This in turn partially financed shields for entrepreneurs during the pandemic. Putting the president of the NBP before the Court of State, according to Politico magazine, makes the central bank independent in violation of the EU Treaty, and besides leads to increased constitutional chaos in the country.

Under the current rules, an absolute majority of the votes with at least half of the statutory number of Members is adequate to put the head of the NBP before the Court of State. However, the Constitutional Court has late ruled that these provisions are unconstitutional.
