First protest resolved: Reasonable allegations of irregularities, but without affecting the result of the vote

This morning in the Chamber of Extraordinary Control and Public Affairs of the ultimate Court, the first of 3 scheduled meetings were held, where electoral protests after the 2nd circular of presidential elections were discussed.

Judges Adam Redzik, Aleksander Stępkowski and Paweł Wojciechowski first dealt with the complaint lodged by Magdalena Miazek-Mioduszewska, and 2 more protests are to be recognized after 11:00 and 13:00.

With respect to the protest of Miazek-Mioduszewska, the ultimate Court considered that the allegations of irregularities in drawing up and counting the protocols were justified, but the deficiencies found did not affect the final result of the vote. As justice Redzik stressed:

"The protestor reported possible irregularities in the preparation of the protocols. ... The NS concluded that the applicant had akin claims’

Among the committees indicated in the protest were circuits from Krakow, Olesn, Minsk Mazowiecki, Strzeżec Opolskich, Grudziądz, Gdańsk, Bielsko-Biała, Tarnów, Katowice, Tychów, Stone Mountain and Brest Kujawski. The vast majority identified "incidental cases" of errors in filling out forms or counting votes, which, according to the SN, were one-off and did not affect the result of the election.

The ultimate Court received a full of around 53 900 protests against the election of the president of the Republic of Poland, any of which are combined by the SN to be jointly examined in individual cases. According to Monika Ludwal of the SN press team, many protests are similar, hence the decision to consolidate papers to velocity up the procedure/

At the same time, any applicants (estimated at respective thousand) will not be allowed to be considered due to ‘formal defects’. On this subject the first president of SN Małgorzata Manowska spoke, pointing to the request to keep procedural rigors. On social media, there were protests modeled on the ready-made form prepared by Mr Roman Gierty with any PESEL numbers, which SN commented on with a decisive document-based response:

“The “Informer” is either fabricated or fabricated,” said the ultimate Court, publishing photos of rejected reports

Before the SN building in Warsaw there were demonstrations of various environments. 1 of them was organized by the environment associated with Robert Bąkiewicz, in which the erstwhile Prime Minister Mateusz Morawiecki and Antoni Macierewicz participated. At the same time, supporters of the recalculation of the votes gathered, manifesting with white-red flags and banners with slogans calling for a reassumption, despite the fact that there are no rules that let the counting of votes across the country.

The background of the full dispute is simply a message by 28 SN judges who challenged the power of the home of Extraordinary Control and Public Affairs to recognise electoral protests. The signatories included voices highlighting a deficiency of compliance with the requirements of an independent, impartial court. The message states:

"In accordance with the current legal system, the ultimate Court, as the authority in charge of justice in Poland, must meet the conditions of an independent, impartial and independent court besides required by the conventions and treaties which are sources of law in Poland. The Chamber of Extraordinary Control and Public Affairs of the ultimate Court is not a court”
