

— I have asked the Ministry of Interior and Administration and the Ministry of Justice to present a fast plan for an immediate consequence to organised crime carried out by foreigners — reported at a conference with Ursula von der Leyen Donald Tusk.
‘Provisions exist. So what does the head of government want to change?"
“It is hard to realize what the Prime Minister’s announcement is about. After all, the current government provides the basis for making decisions on the work to return, that is, deportation decisions, in cases where a foreigner's stay in Poland is simply a threat to public policy or the safety of the state," says Onet Marcin Sośniak of the Helsinki Foundation for Human Rights.
— Moreover, in cases of peculiar threat, for example terrorist, specified decisions can be executed immediately without waiting for an appeal procedure, he explains. “The threat to order and safety is besides a prerequisite for placing a foreigner who is awaiting the release and execution of a deportation decision at a safe facility,” he points out.
— The rules so exist. On the another hand, the Prime Minister did not explain whether and if so, why these provisions are considered insufficient. Crime, especially organised, is surely a problem that requires urgent solutions. However, these solutions should not necessarily be sought in migration law. It may be essential to check first whether it is effective adequate to prosecute and punish specified crimes,” says Sośniak.
“The problem is, however, that announcements specified as this Prime Minister give emergence to the hazard that the needs of the current policy will outweigh the rationale in making or applying the law. It may be feared that, following Tusk’s announcement, there will be proposals for fresh regulations which do not full comply with national law or global law standards,” he points out. “ specified regulations are already in the case of the suspension of the right to global protection announced a fewer months ago and presently pending in parliament,” explains Sośniak.
"The migration subject is politically played"
“Unfortunately, the subject of migration is presently being played politically, to the detriment not only of migrants, but besides of Polish law, the regulation of law and human rights. Experience shows, however, that the best rules were created and developed far from the current policy,” she notes.
— And if they are created in the fever of the campaign, for immediate use, they mostly harm and spoil the applicable law. Therefore, I hope that there will not be any extremist changes in the law now, and if the government decides to change it, this time it will take into account the voices of NGO experts and experts,” Sośniak says.
