Let us remind: Zbigniew Ziobro is suspected of 26 crimes including misappropriation of funds from the Justice Fund and directing an organized crime group. In November, the prosecution requested, among others, temporary detention for the erstwhile minister. It was besides decided to safe his assets.
Therefore, PK wanted to impose a compulsory mortgage of over PLN 143 million on Ziobra's property in Jeruzal, due to the fact that the cost of crimes accused of the politician was calculated enough.
The court decided successfully for Ziobra on real estate
Already in December we wrote on subject that the territory Court of Rawa Mazowiecka did not agree to this. RMF FM writer then learned that the prosecution's application contained "many errors". Now there are reports of others.
This time, the territory Court in Warsaw "removed the property safety imposed on the erstwhile Minister of Justice Zbigniew Ziobry" due to the fact that "the prosecutor entered the mortgage before the Polish Monitor published a resolution of the Sejm on the waiver of Ziobra's immunity".
Although the actual decision to waive the immunity was made, the prosecutor should wait for publication in the Polish Monitor. The RMF 24 article besides revealed that the prosecution had not made a fresh application since the first mistake was detected, but improved the first one.
As stressed "it was his correctness that challenged the advocates of the erstwhile minister in a complaint. The court divided their opinion and the decision to safe his assets had just repealed".
What was the first mistake?
In December, the referee stated that the prosecution's application to safe Ziobry's property contained many errors. At that time, it took up, among others, claims on the basis of which the mortgage was to be entered and neither did the creditor be identified. Furthermore, another property belonging to Ziobra was already secured for the same amount of PLN 143 million.
"In accordance with the rules, the burden of a compulsory mortgage on more than 1 property of the same debtor requires that the collateral be broken down into individual partial mortgages, to cover the claims in full," was given.
On the same day, it was revealed that this was another situation with the amendment. PAP reported that the application was repeated, but was one more time dismissed by the court. "Unfortunately, according to the referendarist who ruled in this case, (ed. – prosecutor) corrected it insufficiently," said Grzegorz Gała, a press spokesperson for the criminal territory court in Łódź.
Let us add that late the Marshal of the Sejm has given not so favorable news to Ziebra. "As you know, the D.A. has issued an APB for Mr. Ziobra. He's looking for him to file charges. The parliament on this case works faster. On 10 March at the Bureau of the Sejm, I will make a proposal to take Mr Ziobrze in the final way of the diet and 90% of the salary," said Włodzimierz Czarzasty.
