Thursday's acceptance of the oath from 4 judges of the Constitutional Court will surely not take place in front of the President, that is, in his presence," stressed KPRP chief Zbigniew Bogucki. He estimated that judges who did not curse to the president would violate the Constitution.
Today on the Polsat News programme – asked where the president would be at 12.30 on Thursday – Zbigniew Bogucki replied, "I don't know; I know that I am gathering with the president this afternoon." At the same time, the invitation to the president to the event in the Sejm called it “an absolutely curiosal thing”. – [...] on what basis is this next day going to take place, I will call it strongly, but actually chucpa? Will it take place? I don't know," he said.
Zbigniew Bogucki stressed that 4 TK judges elected in March must make a vow to the President. I mean, in front of the president, due to the fact that that's a substitute for that word. [...] The question of how this (event) will look. Will it be submitted to the marshal? I don't think the marshal would take that responsibility. possibly it will be against the columns, against the walls. There will surely not be a chance for the President," said the head of the National Council.
In his opinion, in case 4 judges make a vow to individual another than the president, they will be “anti-judges”.
– People elected as judges, but not yet sworn in, who have not taken a vow to the President, [...] break the Constitution due to the fact that these judges say they will not respect the competences of the president of the Republic," he said.
According to Zbigniew Bogucki, coalition representatives "decided to make a majority in the Court that would regulation as Donald Tusk wants".
The issue of the Quark vow on air in Poland24 was asked by presidential spokesperson Rafał Leśkiewicz.
– It's something that any people call taking a vow, that will not be a vow," he said. He added that both the Constitution and the Act on the position of Judges of the Constitutional Court explicitly states that "the elected judges of the Constitutional Tribunal shall take a vow to the president of the Republic".
– In front of the President, this is simply a clear linguistic explanation of the word “against”, said Rafał Leśkiewicz.
The President's spokesperson said that "what is to happen next day will surely not be an act of oath made to the President."
– There's no legal force. Not much – it can be a delicacy. It may be a violation of the regulations," he added. In this context, he mentioned Article 231 of the Criminal Code relating to abuse of powers by a public officer.
A spokesperson for the President, erstwhile asked about the reaction of president Karol Nawrocki to receive invitations from 4 judges, stated that the judges invited the president to a celebration he should invitation them to.
– They set a date, an hour, a place and say: “Mr President, we invitation you due to the fact that we want to make a vow to you. And for the next day," said Rafał Leśkiewicz. He assessed that this was an ‘unserious’ action, so the firm did not take this invitation seriously.
