On Thursday, KPRP Chief Zbigniew Bogucki informed that he had again sent a letter to the talker of the Sejm requesting the presentation of information on the "mode and procedure of verification by the Sejm" that Maciej Berk had fulfilled the formal requirements essential for a justice of the Constitutional Tribunal.
Berek, erstwhile Minister of Supervision for the implementation of government policy, was elected by the Sejm as justice of the Constitutional Court on 4 September. Last week, the president's law firm sent a letter to the Chancellery of the Sejm to explain the circumstances of the formal candidacy, Berk, and KPRP chief Zbigniew Bogucki said that "there are immense doubts as to whether Minister Berek has a ten-year stint of legal counsel".
Last Friday, the head of the Chancellery of the Sejm Marek Siwiec replied in a letter to president Karol Nawrocki that the question of the correctness of the selection by the Sejm of the justice of the Constitutional Tribunal "there is no basis for any rules." He besides pointed out that the talker of the Sejm, Vladimir Czarzasty, expected an immediate acceptance of the oath from justice TK Maciej Berk.
In the opinion of the head of the NRP, Siwiec’s letter to Nawrocki ‘does not constitute any substantive response’. "The full explanation of whether Mr Maciej Berek meets the statutory requirements for him to presume the position of justice of the Constitutional Tribunal, before the president of the Republic of Poland takes his oath, should be seen not only as the President's power, but as an component in the exercise of his constitutional function as guarantor of the continuity of power and guardian of the Constitution," he wrote.
