Belgium: The court ordered Poland to receive the remaining doses of vaccine and pay Pfizer

The Court of First Instance in Brussels ruled on Wednesday that Poland must implement the contract concluded with the American pharmaceutical company Pfizer for the acquisition of vaccines against COVID-19. It is to collect the remaining doses of the vaccine and pay PLN 5 billion 644 million. The conviction is invalid.

The dispute is pending before a court in Brussels due to the fact that that is where the agreement was concluded between the European Commission and Pfizer. The EC concluded a contract with an American maker on behalf of associate States in 2021. Poland has undertaken to acquisition a certain number of vaccines under this agreement in accordance with the negotiated timetable. However, in 2022 she refused to receive further doses.

In September 2023. Pfizer sued Poland for execution of the contract.

The Brussels court ruled on Wednesday that the evidence submitted to it did not let the uncovering of irregularities in the procurement process to Pfizer.

– The court besides stated that the conditions for the termination of the acquisition agreement by Poland were not met and that Poland did not show that the acquisition contract – and specifically its clauses concerning price, number of doses or waiver of liability – indicated that Pfizer’s dominant position was abused – the Belgian court stated.

The conviction is invalid.
