Apple made an urgent request to the U.S. ultimate Court, requesting that fresh charges be stopped at the App store pending consideration of the next phase of the dispute with Epic Games.
The case concerns restrictions imposed on the company, which prevent the collection of commissions on purchases carried out outside the applications. Apple argues that the decision will proceed to be ‘irreparable’.
Regulatory authorities around the planet are following this case to find what Apple's commission rate can be charged to transactions subject to a warrant in large markets outside the United States. The ongoing procedure for determining the amount of commission that Apple may collect should not be allowed – which in itself entails many difficulties and gives emergence to the hazard that courts will engage in inappropriate rates – under the false and biased pretext that Apple has committed a violation of the warrant by collecting a commission based on a warrant that did not even mention commissions.
– reads the justification.
The conflict arises from earlier judgments which forced Apple to let developers to link to external payment methods at no extra charge. However, the appeal court considered that the company should have the right to pay for its technology, and now the lower court is to set the appropriate rate – what Apple wants to block until the ultimate Court decides.
This is another phase of the long-term Apple vs Epic Games battle, which can permanently change the commission model in the App store and affect the company's billions of revenues.
