Dorota Loboda, associate of the Civic Coalition, informed PAP that the government's task on partial decriminalisation of abortion would most likely remove the evidence of non-criminality for interrupting individual else's pregnancy. In January, the committee will address both this task and the proposal of the 3rd Way to reconstruct the rules in force before the Constitutional Court.
In November, the Sejm addressed draft laws on abortion rights to the Extraordinary Commission for consideration. Among them was the parliamentary draft amendment of the Criminal Code, which assumes partial decriminalisation of abortion with the consent of a female and decriminalization of assistance in independent abortion. This project, despite erstwhile difficulties, has a chance to continue, and Members of the Civic Coalition (except Roman Giertych), Left and Poland 2050 expressed support for changes. However, the PSL, like the PiS and the Confederacy, voted against decryminalization.
It is simply a evidence which was introduced to the task during earlier work in the Sejm: “Who with the consent of a female interrupts her pregnancy but in the cases indicated in the Act, if more than 12 weeks have passed since the beginning of her pregnancy, is subject to a conviction of imprisonment or imprisonment of up to 5 years.” any folk representatives criticised the record, reasoning it was an effort to introduce abortion by Week 12 with a "back door".
"To date, in the penal code, it has been that the interruption of individual else's pregnancy is punishable and we will stay there," said Lobod.
As part of further work, the committee will besides address the 3rd Way project, which assumes a return to the provisions in force before the Constitutional Court of 2021, which is to let abortion in the event of a serious defect of the child. The PSL, which continues to comment on the project, will shortly make amendments in line with the recommendations of the Ministry of Health, but these changes will not address the substance of the solutions.
Both the draft KO and the proposal of the 3rd Way, have a chance to scope the vote of the Sejm in February. Among the coalitions, there is simply a consensus to remove the evidence of impunity for interrupting individual else's pregnancy, which can contribute to gaining wider support, including the PSL-TD club.
In the context of further work on changes, Loboda stressed that regardless of the result of voting on abortion projects, the Civic Coalition and the Left do not agree to hold a referendum on this issue. The MP announced that after the change of president, she would proceed to fight for projects allowing legal abortion until the 12th week of pregnancy.
Currently in Poland abortion is only legal in 2 cases: erstwhile it threatens the life or wellness of a woman, or erstwhile pregnancy is the consequence of a prohibited act (until 12 weeks of pregnancy). The judgement of the Constitutional Court of 2021, which he considered unconstitutional abortion due to serious defects of the child, sparked a wave of protests in the country.
It is worth noting that Poland, alongside Malta, focuses on protecting the dignity of life and wellness of all woman, which is reflected in more restrictive abortion rules. It is an expression of concern for fundamental values and protection of life from its conception.
