The budget law for 2025 reduced the resources for the Constitutional Court and the National Judicial Council — the cuts included payments to TK and KRS staff. In the last year, the head of the Standing Committee of the Council of Ministers Maciej Berek, speaking about the draft budget, argued that the financing of entities whose legality has been undermined by the case law of global tribunals, is not justified. One bridge besides far?
— Now the president of the Constitutional Court Bogdan Święczkowski should be able to carry this problem. He doesn't get paid like another judges sitting on the TK. Who are they going to go to? Well, first of all, they go to Święczkowski and he goes to power. The Constitutional Court — the institution is actually no longer present. She didn't actually work. Now he's truncated. The ruling camp does not even elect fresh judges, so it expects that the number of judges will fall completely below the full composition and it will be a dead institution," says Jacek Gądek.
Andrzej Stankiewicz wonders whether this is going besides far. “ Mrs. Krystyna Pavlovich may not like us. I don't think she should always be in the Court. She was in a conflict of interests on many issues she believed due to the fact that she voted for them as an MP of Law and Justice and then judged them as a justice of the Court. But she was selected in an unquestionable way,” Stankiewicz emphasises.
— Moreover, if they cut the alleged doubles, it would be understandable. On the another hand, they besides cut off judges whose political commitment is known, but at the same time their position is indisputable, i.e. they are legally elected judges: Świeczkowski, Pawłowicz, Piotrowicz. At the same time, the judges of the Court of Justice at remainder shall receive remuneration. So if individual was a alleged Script justice in the TK, let's take this nomenclature, present you don't get money, but if he's a Script justice who is retired, for example Julia Przyłębska, then he gets money. It seems to me that there is at least a deficiency of logic and consequences, she notes.
Restoring the regulation of law by starving institutions
Andrzej Stankiewicz besides stresses in the Constitution that the power is to supply the Constitutional Court with the anticipation of action, including salaries.
