The Court of Appeal in Warsaw yet acquitted Tomasz Arab. With him, 2 officials heard the same decision. Earlier, the ultimate Court overturned the Second Instance sentence. The 2019 Court of First Instance for failing to fulfil its duties sentenced Arabs to 10 months in prison in suspension for 2 years. In June 2021, the Court of Appeal upheld the verdict, changing only the description of the alleged acts.

Earlier, the 2019 court of First Instance sentenced Arabs to 10 months in prison on probation for 2 years for failing to fulfil their duties. Monika B. (today with her changed name as Magdalena B.) then heard a conviction of 6 months of imprisonment suspended for a year.
In June 2021, the Court of Appeal upheld both verdicts, simply amending the description of the alleged acts, adding that they acted in their conduct to the detriment of the public and private interest.
In December 2023, the case was referred to the appeal court after the ultimate Court, among others, overturned its judgement against the Arab.
The allegations of defendants (Arabski represents, among others, erstwhile Minister of Justice in the government of Donald Tusk Zbigniew Ćwiąkalski) afraid the "inappropriate cast of the appeal court", which was to trust on 2 judges being appointed by the reformed KRS. arabian lawyers besides claimed that the families of the victims of the crash were not entitled to file a private indictment because... their interests did not endure from the actions of the accused
