On January 15, 2025, the ultimate Court, composed of 7 judges, adopted an crucial resolution on the indexation, on the basis of the civilian Code, of the sum guaranteed specified in the compulsory 3rd organization liability insurance contract. According to the ultimate Court, the indexation of the sum guaranteed in the 3rd organization liability insurance carried out by the court cannot be automatic. The current amount of this sum specified in the regulations cannot be the only criterion for the indexation of the sums guaranteed from old insurance contracts.
