Former Minister Zbigniew Ziobro failed to attend meetings of the Pegasus Investigative Committee 5 times, which the members of the committee considered to be intentional and so requested his arrest. On Monday, the 30-day detention will be decided by justice Tomasz Julian Grochowicz.
Arrest with appeal
On February 20, the Sejm approved motions for a resolution on the waiver of immunity and the consent of 30-day detention for Zbigniew Ziobry, erstwhile Minister of Justice and lawyer General. 239 Members voted for the arrest, 178 opposed, and no 1 abstained.
Earlier, the Parliament's Rules of Procedure Committee recommended that the immunity of the associate of the Law and the consent of the arrest be lifted. This request was made by the Pegasus Investigative Committee to guarantee that Ziobro comes before the Sejm committee.
Ziobro, however, inactive has a chance to appeal. As Mr Dariusz Joński states:
The court will decide. Even if the territory court decides today, Ziobro may inactive appeal to the court of appeal. However, I would like to say that this is simply a alternatively symbolic day, due to the fact that first we had Michael Wosio, the Deputy Minister of Justice, who had the charges filed. Then Marcin Romanowski, who fled to Hungary, and now we have Ziobra himself. This shows what happened in the PiS state, how they treated the law.
January stop
On 31 January, Zbigniew Ziobro was detained by the police and was to be brought to a committee gathering by decision of the court. erstwhile the erstwhile Minister of Justice was transported from tv Republic, where he interviewed the Sejm, the committee voted on a motion to impose order punishment in the form of a 30-day witness detention and concluded the sitting.
The PiS MP explained that his appearance on tv Republic was intended to show that he did not support the activities of the committee, but besides wanted to respect the law.
In September 2024, the Constitutional Court found that the scope of the Sejm's Pegasus committee of enquiry was inconsistent with the Constitution.
The lawyer's eye. Is arrest possible?
The lawyer of Przemysław Rosati of the ultimate Bar Council points out that Zbigniew Ziobry is in favour of arresting Zbigniew Ziobry due to the fact that he did not appear repeatedly despite the call. However, it points out that the court, in deciding to be arrested, would gotta consider that only this most severe measurement guarantees that Ziebra is brought before the committee and that another measures, specified as detention, may prove insufficient.
The lawyer points out that the details of the events of 31 January will be crucial. The court will gotta measure whether the police's bringing Zbigniew Ziobry to the police was effective, or whether political hold in the tv studio of the Republic was intended to deliberately avoid commissions. Przemysław Rosati expresses disappointment at Ziobra's attitude, stressing that as a erstwhile Minister of Justice he should set an example and follow the law.
Eventually, however, Rosatki is not full convinced that the detention will be applied. Ziobro can explain his deficiency of attitude to mediocre health.
