W The session of the Terwaj session on the resolution on the public media, entitled “The draft resolution on restoring legal order and impartiality and reliability of public media and the Polish Press Agency”.
The initiative was supported by MPs from parliamentary clubs of the Civic Coalition (KO), Polish People's organization (PSL), Poland 2050 and Left. The draft was aimed at first reading at the upcoming session of the Sejm.
– The draft resolution on public media, after being signed by the Members of the KO, will be addressed to the Bureau of the Sejm to be straight discussed by the House. – said Bogdan Zdrojewski (KO) president of the Parliamentary Committee on Culture and Transmission.
In the morning, in the seat of the civilian Coalition parliamentary club (KO), politicians of this fact signed a draft resolution on public media. It was announced that the task was planned to be submitted for approval – Michał Kołodziejczak (KO) informed on Monday at Polsat News.
Journalists asked Bogdan Zdrojewski whether the resolution was based on the 2016 Constitutional Court ruling on the National Media Council. Zdrojewski stressed that the ruling of the Constitutional Tribunal is crucial due to the fact that it concerns the constitutional competence of certain bodies, mainly the National Broadcasting Council and the National Media Council, which should not have the powers assigned to it. He pointed out that this aspect must be included in the overall assessment of the current legal situation.
On the question of whether recourse to this ruling would be the basis for appeal of members of the National Media Council, Zdrojewski replied that there were many reasons for action. He stressed that the most crucial thing is the fast resolution of this pathological problem within the current legal order, assigned powers and competences.
Zdrojewski pointed out that the resolution was not intended to liquidate the statutory state, which means that it does not consequence in the liquidation of the National Media Council. It could only lead to the dismissal of individual members. He declared that the draft resolution would be submitted to the Bureau of the Sejm in a fewer hours.
With respect to the statements made by Euro MP Robert Biedron on the WP portal, where he mentioned the change of government media to public media within 24 hours of taking over power, Zdrojewski did not supply a direct answer in this context.
Pluralistic TVP Info needed
– Don't drag us into these declarations, due to the fact that the Left immediately said it wasn't as easy as Donald Tusk said. 24 hours is definitely not enough. Just as TVP Info should not be eliminated, only to make it a reliable, pluralist tv station," said Biedron.
At the same time, he added: “Yes, I can confirm... I think that all these changes will begin today. I think present will be an crucial moment, crucial for making the media civilian and not party."
When asked what would be in this resolution, whether it was the annulment of the election of 1 of the members, or of all members appointed from the provision of the Law and Justice, he replied:
"I don't know, Mr. Editor. Don't ask me that, it is already up to the committee president and the Members of the applicants. They will be formulating this proposal." As he added, his information shows that "the plan is that this decision will be taken present by means of the action of the committee."
"Very Quick" Changes Needed
Kobosko asked whether there would be "express" changes in TVP, he replied: "Changes in TVP, in the alleged public media during PiS times, will be. They must be very fast. Not due to the fact that the fresh coalition is in specified a hurry to get its hands on the media, just due to the fact that it is the anticipation of voters.” "These changes will happen, I am convinced, even before Christmas," he added.
Vice-President of Poland 2050 asked how this would be done, and he replied: “I will not say anything at the moment, due to the fact that the Law and Justice Office has already utilized us to the fact that if any component of the plan is revealed, how can they be welded distant from power, from positions, from stools, they initiate various kinds of actions in Poland and outside Poland, which are to block it, so everything cannot be said.”
Assessment of "law experts"
– I know what methods have been considered and what can be used. It is no longer a secret that – I think this week – in the Sejm we will be conducting a draft resolution on the Council of National Media – a completely artificial and non-constitutional body, which was created by the Law and Justices just to break and circumvent the Constitution of Poland – Kobosko pointed out.
As he said, the legality of the National Media Council, its functioning and individual members was "disputed by law and public media experts repeatedly".
The draft resolution refers to National Media Council in the context of the 2016 Constitutional Court judgment, which stated that it was unconstitutional to entrust the Council with the appointment and dismissal of public media authorities.
Robert Kwiatkowski, politician of the Democratic Left, associate of the National Media Council, opposed to the members of the Council of the Broadcasting of the Law and Justice, he said he assessed the draft resolution as a first step towards the recovery of public media for viewers and listeners.
– This draft resolution gives legitimacy and legal basis for taking more decisive action by the owner, the State Treasury. This is simply a very good start, says Interii. It points out that the draft resolution does not explicitly indicate the circumstantial direction of further action. “There is talk of corrective action, which would point to a non-destructive direction, although in my opinion it is inactive not excluded,” comments Robert Kwiatkowski.
At the minute the session of the Sejm is interrupted. However, this resolution will be adopted present from the information provided by Parliament.
