On March 1, 2019, the streets of the capital of Lower Silesia passed the March in Hołda to the Cursed Soldiers. It was organized by Roman Zieliński (died 12.08.20120) and my modest individual (Jack Międlar – author of the publication). During the demonstration I recalled the silhouettes of the selected Cursed Soldiers and condemned totalitarian regimes: especially communism, as well as fascism and Nazism.
The D.A.'s going down.
Since during the demonstration there was a mention of overrepresentation of Jews in Stalin's safety cameras, the announcement to the prosecutor was submitted by president Jacek Sutryk. The Prosecutor's Office of Wrocław-Old City dismissed the proceedings, indicating that in condemning totalitarianism, recalling historical facts and promoting patriotic values, it is impossible to find calls for hatred against the background of religious, national and cultural differences and to advance totalitarian system.

After the two-time dismissal of Sutryk's proceedings with the engagement of legal advisor Sebastian Polakinski, he filed a subsidiary "private" indictment against me. After a fewer months, the case was dismissed by the territory Court for Wrocław-Śródmieście. The court pointed out that Sutryk has no right to act as a prosecutor (inferiorly: unless he is simply a communist, or a judaic communist, due to the fact that the charge concerns the slogans that have been removed from sentences: Jewish communists were worse than Nazis; Out with the commune; our streets, our houses). The president of Wrocław appealed the decision of the court and the territory Court in Wrocław considered that a trial should be carried out, while violating the rules, granted Sutryk a procedural legitimacy and the case was re-examined by the Court of I Instance. The case was only assigned to a 30-year-old court assistant Michael Basie. The trial's been going on for months. On 13 April 2023, another proceeding will be held.
“Hello to the large Poland” Nazi slogan
After an in-depth examination of the evidence in the form of an indictment, recordings from the manifestation (SEE), and especially the opinion of the expert Paweł Nowak, it should be noted that in my case, lawlessness is one more time applied, including the attribution of words that I have not spoken and the effort to convict on the basis of an expert opinion, which, for example, claims that the slogan “Member of the large Poland is simply a fascist and Nazi slogan”. Don't you believe it? During the proceeding at the territory Court for Wrocław-Śródmieście (file number V K 1093/19), the expert was asked by Janoslaw Litwin (part of the protocol dated 28.04.201021): Is the call “front of large Poland” a fascist and Nazi slogan?What Nowak replied: From the point of mention to the inter-war nationalist, fascist, Nazi organization, of course it is. And as specified it was judged not only by me, but besides by historians. On the basis of this opinion, I was sentenced to 12 months of restrictions on freedom.

Now, in the case concerning the March of 1st maca 2019, the proficient Paweł Nowak – in fact, he is not a permanent forensic expert and is not included on any list of forensic experts – he besides issued an opinion on past and criminal linguistics. Interestingly, historical issues were not actually raised, and during the proceeding in February 2023 he pointed out that another expert should be called upon in historical matters. However, before I decision to specific, scandalous passages from his opinion, I will post a shorthand from my statements and Roman Zieliński, so that you can measure the seriousness of the indictment and the opinion of Paweł Nowak. Then we will decision on to concrete examples of the “work” of the expert.
Roman Zieliński: We meet at the bottom of the March to honor The Cursed Soldiers. Criticism to advance Fascism
The opinion shows that the expert has no thought what the case is, did not get to know the evidence and wrote any “publication” (heavyly called an expert opinion) under a pre-established thesis, in which he takes in defence communism – a totalitarian government penalized by the Constitution itself. For example, he stated that... in the course of the manifestation, there was fundamentally no mention of the Cursed Soldiers, that the Cursed were not quoted by me (read the transcript, watch the video, and measure how it was) and attributes to me words that were not spoken by me, but another person, which is clear from the recordings being... part of the evidence. Moreover, participants of the march commemorating the Cursed Soldiers fighting the Nazis and communists, without any argument, a priori connected to neo-Nazism! There is no end to it, without any factual arguments, the expert convinces that the slogan “National Armed Forces – NSZ” is not “neutral” but is a threat to the persons and social groups identified there or assuming national, racial, political hatred. Following this line of reasoning, according to the expert, the Polish state, the authorities and the full society worshiping the soldiers of the underground of independence, especially on 1 March on the National Day of Memory of the Cursed Soldiers, commit a crime.
Another place he writes: The semantic, semiotic and pragmatic contexts were another slogans and shouts of the type: “Our streets, our tenement houses”, “Together with a sickle, erstwhile with a hammer, in a red rumble”, “And on trees alternatively of leaves will be hung by communists”, which confirms only in addition that both slogans advance a fascist government within the meaning of Article 256 couples. 1 k.k.

“Ungrateful Jew”

He besides accused me of shouting “our streets, our tenement houses” (unless you gotta explain it) and “the judaic communists were worse than the Nazis”, which was surrounded by my words at the monument of Pilecki: I'll let specified a small intellectual exercise. No, I'm not kidding. Following this line of reasoning, e.g. the slogan “beyond Brussels occupation” is the slogan calling for him to execution politicians from Brussels, and the slogan “beyond abroad markets in city centres” calls for killing abroad entrepreneurs? You're being paranoid.
Ziobro could intervene

The case of Nowak in the prosecution
In the case of Nowak, an investigation was conducted by the Prosecutor's Office of Wrocław Stare-City concerning the anticipation of committing a crime with Art. 235 kk, i.e. creating false evidence. After proceeding the website and accepting evidence in the form of, among others, “contropiny” of a forensic expert – a prof. in forensic linguistics with more than 20 years of experience, in which the expert pointed out the impermissibility, imprehension and illogicalness of Nowak's opinion. At an express pace, the prosecution dismissed the proceedings, claiming that not sharing the expert's opinion cannot lead to criminal proceedings against him.
Expensive “expert”
The Wrocław D.A.'s office gave Nowak a green light to produce more “bits”, for which he takes a tiny amount of money (this cost is most frequently charged to me – I was presently charged with court costs of up to PLN 15,000!). The opinion I quoted cost PLN 3179.62 gross. It is worth to add that all opinions are mysteriously akin (“copy”+”paste”?), written on “one hoof” and fundamentally on respective pages (in this case 2,5 pages). For comparison, a actual forensic linguist writes an opinion on 50-80 pages, for which he takes almost identical money.
– The expert so completely ignores the context background, which is incompatible with the complex declaration of taking into account the methods of pragmatic analysis– writes the expert prof. in respective ten-page “contropiny” of opinion. Among another things, he adds: – Paul Nowak's opinion is incomplete and has been elaborated indecently, inaccurately, and unfairly. It was not released according to the principles of criminal linguistics.
Scandalous thesis and false quotes in the indictment and expert opinion, I could multiply and multiply. And that's what I'll do at the earliest chance to attest in court. At the same time, along with my defence lawyer paid thanks to yours financial support, we will persuade the young asessor to accept the opinion assigned to cases in the Wrocław court of substantive expert in criminal linguistics. I find it hard to believe that the justice himself did not see the unfaithfulness, or even the insolence, which Paul Nowak did in that opinion.
