In particular, the Head of Government pointed to the ineffectiveness of the European Arrest Order (ENA) for erstwhile Justice Minister Zbigniew Ziobra. The Prime Minister stressed that the absence of ENA was the consequence of a decision by a court which found the application irrelevant due to the deficiency of the anticipation to indicate the whereabouts of the fishy in Europe. The head of government pointed out that in these formal disputes between the prosecution and the court, the Polish state is losing, as he stated as follows:
"It is annoying that this coordination between the prosecution and the court does not look, frankly speaking, good. (...) In these disputes, I would say, formal, what is most crucial is the effectiveness of the Polish state in pursuing alleged criminals, including erstwhile politicians."
Tusk's Apology
The Prime Minister besides referred to restrictions on the reforming of the prosecutor's office, bearing the work for this state of affairs of the current political agreement with president Andrzej Duda and president Karol Nawrocki. According to the head of government, the existing laws, which he defined as written and unconstitutional, prevent the real reconstruction of prosecutorial structures without the President's approval.
Tusk assessed the situation of Minister of Justice Waldemar Żurek as difficult, indicating that despite his determination, the actions of the lawyer General are blocked by the current legal order. The Prime Minister acknowledged that he lacked predictability on the organization opposition scale in his earlier statements on settlement pace:
"Sorry, I should have had more imagination erstwhile I announced fast settlements. I did not anticipate this to be so hard in relation to the situation, among another things, in the prosecution’s office.”
