TEU: WIBOR clauses are subject to scrutiny under EU law. Advocate: judgement C-471/24 opens a fresh phase in dispute over gold credits

The Court of Justice of the European Union issued, on 12 February 2026, a judgement in Case C-471/24 concerning mortgage loans at the WIBOR rate. The case was initiated by questions from the territory Court of Czestochowa for a preliminary ruling and dealt with a fundamental question: whether variable interest clauses referring to WIBOR as a benchmark covered by the regulation of BMR (2016/1011) can be examined in the light of Directive 93/13/EEC on unfair terms in consumer contracts. The most crucial thesis of the judgement is clear: the specified fact that WIBOR is simply a regulated indicator at EU level does not exclude the anticipation of controlling specified clauses in terms of consumer protection.
