– The proposed Act amending the tiny and average Entrepreneurs Ombudsman Act came out as a government task from the Ministry of Development.

It is already included in the list of legislative work and I hope that it will be adopted in the second 4th of this year," says Newseria Agnieszka Majewska, European Ombudsman for SMEs. "It assumes not only to change the Ombudsman's competence, but besides the names – it will be the Ombudsman of Entrepreneurs' Rights, and therefore, we will have all the entrepreneurs, including farmers, under the care of us, due to the fact that to date the bill has unfortunately not allowed us to support farmers.

The bill is to be handled by the government in the following weeks.

The existing provisions were adopted in March 2018. According to MRiT, for more than 6 years they have been identified areas of interpretative deficits and loopholes, so the fresh bill is intended to offset them in order to enable the Ombudsman to supply even more effective support to entrepreneurs. Strengthening the function of this body is intended to straight improve the legal environment for business in Poland, creating better conditions for entrepreneurs to operate and develop.

In addition to farmers, the Ombudsman of Entrepreneurs' Rights is besides to be protected by free tradesmen as well as members of a single-member limited liability company and members of a public, limited-liability or partnership company, a shareholder of a simple joint-stock company contributing to the company or a subsidiary of a limited-liability company.

The Ombudsman will be able to have an EU typical in Brussels

– The task besides mentions that we will be able to support partners, e.g. a public company or a limited partnership, due to the fact that so far, as the decision was made as a partner, specified a partner is not an entrepreneur, only a natural person, and we could not proceed to specified proceedings – says Agnieszka Majewska. "Another thing, very important, is that we can have our EU typical in Brussels.

MRiT stresses that there are presently insufficient solutions to enable the Ombudsman to play a more active function in the process of creating and monitoring EU government on business rights and interests. It is crucial that a crucial part of the regulations in force in Poland that specify the conditions for conducting business activity has its origin in EU regulations.

The Ministry has no work to submit projects to us, so any don't.

– And the most crucial thing is that the Ombudsman is to have a legislative initiative, that is, all projects will should be submitted to the Ombudsman, we will be able to respond to them, but we will besides be able to submit our projects," says the SME spokesperson. To date, the deficiency of the work to consult the Ombudsman with draft economical law rules has led to situations where the office has been overlooked in the process of creating regulations that are crucial for the rights and interests of entrepreneurs.

– The Ombudsman only gives opinions on draft normative acts, and that is not all, due to the fact that they do not all go to the Ombudsman's Office. The Ministry has no work to transmit projects to us, so any do not. If this work is already in place and we can take part in the legislative process, we will besides have the chance to decide how these rules are created. I hope that this will strengthen not only the SME sector, but all entrepreneurs in Poland – says Agnieszka Majewska.
