"The Rebellion of the Polish Constitutional Tribunal". Strong Opinion of the Advocate General of the CJEU

The position adopted by the Polish Constitutional Tribunal in its judgments of 14 July and 7 October 2021, which constitutes an unprecedented "rebellion", violates the primacy, autonomy and effectiveness of EU law, the Advocate General of the CJEU stressed in his opinion issued on Tuesday. He considered the complaint of the European Commission against Poland to be justified.
