The ordering organization has a free hand in selecting a contractor from 3rd countries

The legislator will delegate to the contracting authority the decision whether to let a contractor from alleged 3rd countries to participate in the tender. The applicable draft act has been submitted for public consultation - it was reported on the RCL website. The draft act implements the judgement of the ECJ of October 2024.
