The Advocate General of the CJEU, Tamara Ćapeta, proposed that the Court should declare itself incompetent in a case concerning the composition of the ultimate Court. However, if it wants to issue a verdict, it should consider that a "mixed" panel, with the participation of incorrectly selected judges, is not an independent court," she added.
