The author of the broadcast Dorota Kania, Michał Adamczyk, who was then the editor-in-chief of TVP SA and TVP itself, is expected to pay PLN 200 thousand. Dr. Jolanta Hajdas, manager of CMWP SDP and economist Dr. Artur Bartoszewicz were sued for amounts of PLN 100 thousand. Sebastian Kulczyk, Artur Bartoszewicz and Jolanta Hajdas were interviewed on June 26. The court rejected all evidence requests by defendants and refused to question the witnesses identified by journalists. He agreed to question all the persons requested by the plaintiff. The next trial is due in October.

The disputed episode was published on 19 June 2023, entitled “From TW Paweł to Kulczyk Holding”. It presents, among others, the past of late businessmen, Henryk Kulczyk, and his boy Jan Kulczyk. In the opinion of defendants, journalistic material was created with the highest standards of journalistic art, and all message in it was based on papers located at the Institute of National Memory, information made public by the National Prosecutor's Office and on the basis of the audit results of the ultimate Audit Office, which showed negligence and violations in companies led by Jan Kulczyk.
During the proceeding on June 26, the plaintiff Sebastian Kulczyk, the suspect Jolanta Hajdas and the suspect Dr. Artur Bartoszewicz, an expert – economist for economical affairs answered. Sebastian Kulczyk explained why he felt that the statements of the defendants violated his father's memory, even though he could not indicate how circumstantial words affected the reception of the deceased John Kulczyk or his household among the public and whether their opinion had deteriorated since the publication of the recording and broadcasts. Nor did he indicate that any harm had to do with the publication of this programme. Jolanta Hajdas justified her speaking in the ed material. Dorota Kani, as a writer of public media in Poznań in the 1990s, has repeatedly dealt with controversy about the privatisation of various companies, or the construction of the A2 motorway, and her words are her current opinion on the situation at the time. Dr. Artur Bartoszewicz testified that, as an economical expert, he based his statements on the 2018 NIK study on irregularities in the privatisation of Ciech.
The defendants powerfully request that the action be dismissed in its entirety, besides drawing attention to the striking disparity between the compensation requested by the Kulczyks' siblings and the scale of alleged individual property violation. In the opinion of defendants, these amounts are separated from Polish socio-economic realities.
The case is led by the justice of the territory Court in Warsaw Mariusz Solka. He rejected the requests of journalists' defender Artur Wdowczyk to interview witnesses including prof. Sławomir Cenckiewicz and investigative journalists ed. Whereas Anita Gargas and Cezary Gmyz, he agreed to interview 2 witnesses named by the siblings of Kulczyk. Another proceeding is scheduled to take place in October.
