Composition of the Court of State to the Maciej Świrski case drawn. ‘Probable redemption’

On Tuesday, 2 September, the Court of State judges were drawn to consider the motion of the Sejm to call the erstwhile president of the National Broadcasting and tv Council Maciej Świrski for constitutional responsibility, stated RMF FM.

The radio reports that as a consequence of the draw, only 1 justice elected to the Court of State by the ruling coalition was sent to the erstwhile KRRiT chairman. It is appointed as rapporteur by Marcin Radwan Röhrenschef, appointed to the Court by the 3rd Road. The remaining elected judges were elected by the votes of the opposition. Among them are recommended by the Confederate composition president Marcin Miłosz and recommended by PiS Adrian Salus, Piotr Sak and Marcin Wawrzyniak.

Application for a Court of State for Maciej Świrski

In May, a group of 185 Members made a preliminary request to bring Maciej Świrski to the Court of State. Applicants accuse the erstwhile head of KRRiT of blocking approx. PLN 300 million from a subscription for public radio and television, blocking concessions for private broadcasters (TVN, TVN24, TOK FM Radio, ZET Radio), and besides not performing statistical surveys on tv stations' ratings in Poland.

At the end of July this year The Sejm adopted a resolution to hold the Court of State accountable Maciej Swirski. 237 Members voted in favour, 179 voted against. “I have decided that I do not accept this result,” commented Swirski.

— I will not resign, nor will I suspend, nor will I change my position on the National Broadcasting Council," Świrski said after the vote in the Sejm. He covered himself with the Constitutional Court ruling, which ruled on Wednesday 16 July that the provisions governing the appointment of the Constitutional president of the National Broadcasting Council were unconstitutional.
