The Advocate General of the European Court of Justice on the Constitutional Tribunal: an unprecedented rebellion

The Advocate General of the European Court of Justice has ruled that the complaint of the European Commission concerning the Polish Constitutional Tribunal is well-founded. In his opinion, he emphasised that "the position adopted by the Polish Constitutional Tribunal in its judgments of 14 July and 7 October 2021, which constitutes an unprecedented rebellion, seriously undermines the primacy, autonomy and effectiveness of EU law".
