The president of the KRRiT at a press conference after the Council gathering announced that he would submit a announcement of the anticipation for TVP liquidator Daniel Gorgosz to commit a crime! The case concerns "an illegal cut-off of TVP's access to TVP archives in liquidation". Maciej Świrski presented KRRiT's allegations about the debate organised by Rafał Trzaskowski's staff in Koński, in which TVP was active in liquidation. He besides commented on the scandalous resolution of the WSA to retreat the tv concession in Poland24.

According to Maciej Świrski, 1 of the crucial points of discussion at the KRRiT gathering was that “according to the majority of KRRiT, TVP illegally cut off access to TVP archives in liquidation”.

I decided that after proceeding the arguments from the KRRiT members and the KRRiT staff, I decided to mention the prosecution to a study that Mr. Gorgosz, the TVP liquidator, suspected of committing a crime. Offence to restrict citizens' access to information, which is to break the constitutional regulation and introduce censorship

This is simply a case of so much scandalous and so crucial that the content to which access has been cut off is the content for which the authors were paid the money from the subscription and from the peculiar subsidy (...). Consequently, cutting citizens off from the content they deserve from the point of view of the origin of this money is an additional delicacy in this full case.

Breaking the law on the debate in Koński

The president of the KRRiT revealed that the gathering besides discussed the outrageous public situation in Koński, where Rafał Trzaskowski's staff organised a debate held by 3 of his TVs, including TVP in liquidation.

I wrote to the president of PKW about this event. In my opinion and most of the KRRiT, the law has been broken in specified a way that the rules governing electoral debates have been broken. This is primarily an article of 120 electoral code which says that TVP is required to hold debates between candidates for the office of president of Poland. Details in this respect are regulated by the KRRiT Regulation of 6 July 2011 (...). This regulation states that TVP should guarantee a level playing field for each candidate in the debate, let them to participate in the same number of debates, guarantee equal speaking time in the debates, guarantee the same time of issue of debates with tolerance plus minus 15 minutes, inform candidates at least 48 hours before the issue of the debate on (...) subjects of the debate, hold this debate without public participation in the studio. As we know, what happened in Koński did not meet these criteria of the regulation and was announced as a debate

Later TVP withdrew from talking about organizing anything, taking on the staff of 1 of the candidates, the problem is that it was not this program aired on the public broadcast waves as a material of electoral agitation, only as simply a TVP program, that is, it should be said that this is simply a debate in accordance with the provisions of the Act. If so, we are in breach of the following rules

He added, mentioning, among others, the violation of the rule of allowing all presidential candidate to debate.

We have a situation where TVP first says that there is simply a debate and breaks the rules on the debate, then withdraws from it and says that this is not a debate, but that does not change the fact that if it is not a debate, only the election material of 1 of the candidates, then it should be marked on the screen. (...) If the PKW considers that the programme aired by TVP does not constitute a debate, it should be classified as electoral agitation. The electoral code does not supply for another forms of engagement of broadcasters in the electoral campaign

This issue must not be overlooked in any way in the deliberations on this election campaign, as the KRRiT is monitoring the run and concrete conclusions will be drawn from this issue.

Repeal of concessions in Poland24. Pigs: It's a judicial prank

Maciej Świrski was asked by a tv writer in Poland24 Maciej Revenge of the outrageous decision of the Provincial Administrative Court to revoke the decision of the KRRiT granting a concession on a nationwide multiplex for tv in Poland24 and tv Republic.

With respect to this situation of judicial misconduct, which was the repeal of the concession by the WSA, it is simple from a legal point of view – the court is of its own motion to give us the reasons for this judgement (...). On the basis of this justification, we will be filing an erasure. Similarly, participants in the proceedings, namely tv in Poland24 and tv Republic and the 1 by whom the full process was initiated, or Mr. Winnicki's channel, are entitled to cast the cassation, or what is called Free Media or whatever it is called

What's next is, we'll see what the time will be for the court to compose a message of reasons, erstwhile we get it, and then we'll decide what this erasure will look like.

The president of the KRRiT besides referred to the effort by Coalition politicians on 13 December to bring him to the Court of State.

I think these are threats to intimidate the KRRiT and me personally, and we'll see what this committee can come up with, then I'll mention to it and decide what to do.
