From the substantive point of view of the hearing, they focused mostly on their business activity in Poland, for example in the context of the correct conduct of taxation cases by companies. In parallel to the hearings conducted, the taxation authorities initiated fiscal controls in these companies [...]. The referee’s prosecutor was not curious in the circumstances relating to the determination of the nature of the offence under Article 286(1) of the Code, which was to mislead the victim, while contracts were repeatedly asked about
concluded by the victim with Silver, knowing from the outset that the victim had taken steps to implement the improvement task on the basis of oral arrangements and had not signed any contracts. Although the injured individual was interviewed 7 times in the course of the investigation, the referee imposed fines on him after PLN 3,000 for non-commissioning. All these penalties were waived by the territory Court in Warsaw, after designation of complaints by the victims' representatives. On 11 October 2019, a decision was issued to refuse to initiate an investigation in the absence of statutory criteria for a prohibited act.
It is unnecessary to mention the substantive arguments expressed in the decision to refuse the initiation of the investigation, as they have circumstantial accents and focus exclusively on the individual J.K. and the desire to excupulate him. This decision was retained in force by a court that did not take into account the complaint of the injured party’s representatives. The investigator assessed this decision as premature. In his view, the circumstances indicated in the written announcement of suspicion of a crime, supplemented during the first proceeding of the notifier, indicated a reasonable suspicion of a crime and required the initiation of an investigation. The conduct of this proceeding in the form of an investigation procedure and, in fact, an investigation, was justified on non-essential grounds, i.e., as to be thought, by seeking to avoid J.K. hearings as a suspect." And announced the reopening of the case.
