The investigation was initiated in early 2024 after media reports, in which it was suggested that an illegal abortion occurred in the territory infirmary Complex in Oleśnica. The case active a doctor, Gizela Jagielska, who gave potassium chloride straight to the heart in the ninth period of pregnancy. Earlier, a gynecologist published on the net recordings in which she informed about abortions.

Following these publications, on 16 April, Euro MP Grzegorz Braun invaded the infirmary area, attempting to arrest a alleged civic doctor. Jagielska herself maintained that her actions were consistent with both the principles of medical art and the well-being of the patient. Media communications besides indicated that the unborn kid suffered from congenital bone fractures.

Gizela Jagielska without judgment

By order of December 2, 2025, prosecutor Beata Ciesielska dismissed the proceedings, stating that the absence of the prohibited act was a factor. The Prosecutor's Office analysed 3 threads related to Dr. Gizela Jagielska's actions, examining them in the context of the provisions of the penal code and the household Planning Act, the protection of the human fetus and the conditions for abortion, erstwhile the fetus reached the ability to live independently outside the mother's body.

The first subject afraid the death of the kid itself, the second referred to the possible assistance in the illegal abortion between 21 and 29 October, and the 3rd subject included the suspicion of urging an illegal abortion.

In any of the areas under consideration, the prosecutor has not found that Article 152 of the Criminal Code has been breached to deal with illegal abortion issues. The prosecution, on the another hand, explained:

Patient's psychiatric certificate, issued during the treatment process, stating the risks of wellness and life, does not rise any objections to its reliability, expertise and completeness.

Braun may be in trouble.

An entirely separate issue is the investigation into Grzegorz Braun. It is managed by the territory Attorney's Office in Wrocław. In November, the European Parliament lifted immunity from Braun, which allowed further legal steps to be taken, including possible charges.

Investigative findings show that charges against Braun may concern, inter alia, the unlawful imprisonment of a doctor, the violation of her physical immunity by pushing and holding her, insulting her while performing her duties, and claims for actions undermining her trust in the profession of doctor. Gizela Jagielska herself indicated that Braun had entered the administrative part of the hospital, blocked her exit and locked her in the room, preventing her from doing her job.

However, Braun is not the only individual charged. During the prosecution proceedings, they were besides erected by Marcie Cz., an activist of the Confederation of the Polish Crown. According to investigative findings, it was intended to prevent Gizela Jagielska from leaving the medical office during actions undertaken by Grzegorz Braun. The prosecution besides accuses her of violating the physical integrity of the doctor by physically maintaining her while performing her professional duties.
