The detention session on the erstwhile Minister of Justice and erstwhile lawyer General Zbigniew Ziobry has already been postponed twice: 22 December and 15 January. Another date was set for Thursday 5 February. The case was handled by justice Agnieszka Prokopowicz.
Zbigniew Ziobro received global protection in December 2025 from the Hungarian authorities, who estimated that erstwhile ministers were threatening political persecution.
The defence of Zbigniew Ziobry made a statement. He wants to change the court.
TVN24.pl reported that about half an hr after the beginning of the gathering a first fewer minutes break was ordered. During this time, Zbigniew Ziobra's defenders made a statement.

TVN24.pl continued to study that after respective minutes another ordered break began, during which the mec. Gomola submitted: – The court dismissed the application to mention the case to the ultimate Court, considered that there was no reason to do so.
Zbigniew Ziobry's defender besides informed that as a consequence, the defence had filed another motion to "order the examination of this case in the composition of 3 professional judges due to the peculiar importance and complexity of the case."
Gomoła besides added: "This case concerns the Ministry of Justice, concerns 2 Deputy Ministers of Justice and respective another people, including the directors of the department. There has not yet been a case in the past of the III Republic in which the full management of the Ministry of Justice would be subject to charges.
Mec. Lewandowski, in turn, stated that this request for an extension of the composition of the justice was recognised by the president of the territory Court.
Third break and subsequent motions by Zbigniew Ziobry defenders
Shortly afterwards, a 3rd break was ordered, which, as Mr Lewandowski said, was caused by "another motions made" of defenders. The media besides found out that the erstwhile application for an extension of the judge's composition was rejected. As for the fresh conclusions, the lawyer said that he does not want to talk on this subject right now, as "they are more substantive".

The gathering began on Thursday 5 February at 10 a.m. A request for possible detention was made by the National Prosecutor's Office in connection with an investigation into the Justice Fund. The D.A. wants 3 months' detention for Zbigniew Ziobra for fear of escaping, hiding, and trial harassment. Investigators want to charge the erstwhile minister with 26 charges, including 1 for moving an organized crime group. Ziobro, meanwhile, rejects the charges: as he says, acted under the law.
– I hope that present a substantive decision will be taken – he passed before the Thursday court meeting, as quoted by TVN24.pl D.A. Piotr Wozniak, who is investigating the Justice Fund. “The next decision will be to issue a BOLO and request a European arrest warrant,” he informed.
Prosecutor Wozniak besides explained what would change the fact that Zbigniew Ziobro has granted political asylum. “Political asylum granted to a individual in pursuit of a European arrest warrant is not an obstacle to the implementation of a European arrest warrant,” he explained.
The prosecutor investigating the Justice Fund declared: "I stand in the position that temporary detention should be applied in this case. Even due to the confirmed fact of hiding a fishy from law enforcement.
On the case of Zbigniew Ziobry, his defender, Bartosz Lewandowski, besides spoke. In a comment before the sitting, he stated that "on the Justice Fund judges may be afraid to make decisions", and besides declared that the defence would make a number of proposals on the "repression" case for judges.
What if we agreed to arrest Zbigniew Ziobra?
