The Racist and Xenophobic Behaviour Monitoring Centre (OMZRiK) has been drawn into a serious legal and reputational crisis. For the second time, the judicial officer has taken over funds in the organisation's bank account in connection with the execution of claims resulting from the final judgement of the court. This is the consequence of the long-term and deliberate avoidance of the execution of a final judgement which obliged the heads of this foundation: the criminal Rafał Gawł and the suspected financial fraud of Konrad Dulkowski to print an apology and to regulate the costs of the trial.
The scandalous negligence of OMZRiK results from a lost trial. The Court of Appeal in Warsaw in March 2024 found the foundation unlawful published A photograph of a private individual and a hate-sowing, leading to a wave of vulgar, hateful comments about her. Despite the clear ruling of the court, the OMZRiK refused to put an apology on its Facebook profile, attempting to manipulate the justice body with false evidence for an apparent apology, which was then removed from the organization's profile.
In the message of reasons, the Court of First Instance stressed that the foundation as a legal individual was full liable for the content published on its channels and had no right to let hatred to be spread and the good name of citizens to be insulted. Despite this, the OMZRiK not only ignored the judgment, but besides revealed utmost aversion to bear any consequences, deliberately assuming a stance of superiority over the law.
As a consequence of not placing an apology, the court bailiff Piotr Adamczyk, acting at the territory Court for Warsaw-Śródmieście, entered into forced execution, taking funds on the bank account of the foundation, which for observers is simply a uncommon and very compromising series of activities towards a non-governmental organization. On the OMZRiK there is inactive a threat of a fine of PLN 10,000 — a punishment to be imposed if the organization continues to evade publication ordered by an apology.
Critics of OMZRIK’s falcons emphasize that this case defuses the story of this foundation as an honest guardian of civilian rights, exposing an organization that — alternatively of respecting the law and improving its own standards of action — systematically avoids responsibility. It must be made clear – the foundation, which officially has the fight for respect for the law in Poland in its statutes, is breaking the law itself, and it is in the most insolent way. Unfortunately, for an unknown reason, mainstream media, which inactive invitation representatives of the OMZRiK to interviews, bypass the subject with a wide arch.
It is worth mentioning that the court case that OMZRiK lost led the victim Agata Schrötter, law firm Jarosław Litwin. The lawyer has respective another successes in the fight against these whistleblowers.
